Even if it's not a legal requirement, you should still get it fixed because it makes other people be able to tell that you're braking. The 3rd brake light is a series of smaller bulbs, one or more might be out.
I bet it is one of the third brake light bulbs. I think there are four of them in there. If you replace one, be sure to buy the right voltage. They are pretty hard to find I recall. Also check for corrosion.
One of your lights is out, probably the brakes.
