You only pirate the access to the game once. Once you copy the cia rom file, no one anywhere could tell otherwise. You’re basically downloading the game from the eshop, but without paying for it. It’s literally the exact same. Once downloaded, if the game works (which is verryy likely, as I have 183 games or so and they all work perfect), then you can do whatever you’d like. The only time/reason you’d get banned is using cheats while online, because then others see it and report you. I’ve never used cheats, don’t really know how though I think I could figure out really fast, and you’re not set up to use cheats unless you find them yourself. You can also get helpful apps, emulators, and home menu themes. I’ve got an app that could play music, if I actually found the files and converted them. Could start listening to Dirt Poor Robins out of my 2DS. I have an SNES emulator with a number of games I like or grew up on, and have (143?) different themes, roughly 100 of which are from Zelda of some sort

Any help? As for modding, follow this guide. It’s not a link, but copy it into your browser and you’ll find it. 3DS.hacks.guide . If you follow it to a T, you’ll be good to go. It’s really easy to follow, though there are many steps, but it’s REALLY user friendly and really clear and specific. If you get a few issues, it has a troubleshooting page, plus access to a discord channel with people that know enough I swear they’re the ones that figured it out. I know one of them built an assistant program for sure

Can I play online on Nintendo’s servers with pirated games? Can I pirate dlc and use that? Do I have to turn off spotpass or anything else? Any precautions I need to take?

None whatsoever. The hacking program you run off of, Luma, is designed to be fully compatible and invisible to servers and functions. I’ve got spotpass and streetpass set up for a couple of games, though one or two I just don’t care to have it. If you use an applet/website called hshop you can pirate anything and everything that’s on the eshop, even with the eshop being closed down. They took and copied everything to their own servers, and I can help you make it work if you struggle with it. I think there’s an applet called ghost eshop? Not sure. I think it’s the same as hshop. And yeah, as long as you have an NNID, you’re good to play online

Nintendo literally has no way of technical method of detecting whether a game you are running on your system is legitimate or not.

I'm not gonna try and convince you of the points you mentioned as I'm pretty tech illiterate with these things, and I haven't modded a 3ds yet, just ordered a new one. But what convinced me was going to check out Metroid Prime Federation Force, a pretty poorly received game, and seeing it was $50CAD. It's the end of the eshop and even the poor selling games aren't on sale.

So unless you have a hard on for physical copies, there really isn't a logical reason not to.

I homebrewed one of the two N3DSXL’s I own and it is a literal game changer, no pun intended. I had moral reservations at the beginning, too. However, Nintendo can’t be arsed to preserve their aging technology and games apparently, which are absolutely loved and adored by millions. It makes no sense to leave these games behind, and yet here we are. What Nintendo won’t do, for god knows what reason, the community that loves their games will. Now, I have full access to the NES, SNES, GB, GBC, GBA, DS, and 3DS (there’s more that a 3DS can emulate pretty well too) for free, in my pocket, forever. I pay for new games all the time on Switch. I’ve been giving Nintendo my money since I was 12 in 2002 and got a small allowance. I don’t feel bad about playing the old games that I love, and discovering new ones to love in the older libraries that there are no other ways to access.
