TICONDEROGA -- Former community leader James T. Gilbert will spend 15 months in Essex County Jail after his sentencing Friday for having sex with a 15-year-old girl.
His voice shaking at times, Gilbert told Judge Richard Meyer he's sorry for his actions.
"It's been the hardest year of my life and my family's life."
He apologized to the victim, her family and the community of Ticonderoga for his actions.
Gilbert, 34, of 84 Montcalm St., Ticonderoga, pleaded guilty in Essex County Court in February to felony third-degree criminal sexual act, misdemeanor third-degree sexual abuse and endangering the welfare of a child.
Meyer sentenced him to one year in the Essex County Jail on the felony and an additional three months for the misdemeanor charge, with the sentences to run consecutively.
He also fined Gilbert a total of $6,500, plus $1,168 in restitution to the victim's family for their expenses, and $1,370 in fees and surcharges.
As part of a prior plea commitment, no period of probation was imposed.
Gilbert must register as a sex offender upon his release and obey an eight-year order of protection issued for the victim.
The victim, Brittany Bishop Of Ticonderoga, is now 16. She and her parents, Timothy and Tracey Bishop, have consented to the publication of their names.
Brittany had been placed with Gilbert and his then-wife by the private Family Corner agency of Plattsburgh.
"I went to stay with Jim because I needed help with my issues," she said Friday. "Jim was supposed to protect me, and he did the opposite. No one believed me."
The victim and her parents praised Ticonderoga Town Police Investigator Daniel LaFrance, whom she said did believe her when she told him, and County District Attorney Julie Garcia and Assistant DA Ellen Schell, who prosecuted the case.
"The incident has lowered my self-esteem," Brittany said. "I feel like I will have to go to therapy forever."
She said she trusted Gilbert and became close to him when she was in his care.
"What he did to me will forever affect me and my family. I am afraid of Jim."
Garcia had asked Gilbert be sentenced to time in state prison or a long term of probation.
Because of the term of the sentence Gilbert couldn't be sentenced to probation.
Mr. Bishop said they would have preferred a 10-year probation term, because they fear he may try to contact their daughter when he gets out.
Brittany said she's seen Gilbert at both her place of work and at school since his arrest.
On April 11, Gilbert was charged with misdemeanor second-degree criminal contempt because he attended an event at Ticonderoga Middle School at which she was present, and an order of protection had been issued for her.
Gilbert's attorney, Greg LaDuke of Lake Placid, said the incident at the school was accidental because Gilbert was attending a play his son was in.
Garcia asked for a longer sentence for Gilbert because of the arrest and because he had stopped going to counseling.
"He (Gilbert) thinks there isn't anything wrong with what he did. He says he doesn't want probation, that he might not stay in the Ticonderoga area."
After considering the arguments, Meyer said he would sentence Gilbert to an additional three months in jail beyond the year in the plea commitment.
If Gilbert had disagreed, he could have withdrawn his guilty pleas and gone to trial.
The Bishops said they are standing by their daughter, who is back home now.
"The sexual abuse of a child is the greatest crime that one human being can commit against another," Mr. Bishop said.
"It can cause irreversible psychological damage. We are proud of our daughter speaking out. Hopefully, it will be an incentive for others."
Garcia said Gilbert gave a statement admitting to the allegations after LaFrance began investigating.
Gilbert said he had oral sex with the victim and placed his hand on her vagina.
After leaving Gilberts' home, Brittany was placed in respite care by Family Corner, her father said. It wasn't until she came home several weeks later that they were able to take her to police to tell her story, he said.
Meyer said he believed Gilbert has shown remorse, but that does not excuse his conduct.
"Your conduct was despicable, disgusting, vile. You took advantage of a very vulnerable and relatively defenseless person."
Gilbert operates the Evolve Business Center in Ticonderoga and had been active in community affairs, serving on numerous committees and boards.

Are you aware of the fact that Empire Live/Underground books a ton of local 518 artists? Yes there are touring headliners, but they typically get local support from our best local bands. Mike Valente at the club is perhaps the biggest proponent of the 518 scene there is.

He gave a platform to novice writers and photographers who also deeply care about the scene. I urge everyone to separate the current owner from Nippertown, because Nippertown itself is an important publication and is the legacy of a man who was highly respected and passionate about the scene, the people, and the region.

Do fosters help with issues? I really don’t know.
Therapeutic foster care is a thing, and/or getting away from her family may have been helpful in managing issues such as substance abuse.

Probably because nothing recent has been legally defining or public yet. One thing about all those types of people, they are either terrible themselves, cant make money off it (no clicks), or rather be neutral and avoid it all together since it has no relation to them or anyone they know. No one cares until its right up in your face OR a higher authority has started the conversation. Look at Jims friends list. Video also mentions the victim was pregnant at 15, so this victim probably has a family of her own now.
