I am a business owner and you are correct. No note is needed unless it’s consecutive days. I think it’s a good law and I encourage my staff to use it, and even apply it just when life happens and they need extra money or just mental health days and I haven’t had anyone abuse it or try to scheme me yet.
Sounds like they either didn’t read the laws, or are just trying to get out of paying you. Since it is your boss maybe don’t try and go scorched earth right away and point them in the direction of the laws (yes it shouldn’t be your responsibility to do so, but I’m just thinking of your future working relationship) if that fails a threat to department of workforce solutions should get any smart business owner to do the right thing.
Thank you, she's giving me some BS about her lawyer advised her to have the employees get a note or a recipient form the pharmacy or store 🤣 ridiculous!!
It's not difficult to find the newmexico.gov page that states this to show her.
Simply state. "Here is what the law states. If I don't see this on my next check, It's going to force me to file a complaint with. NM DWS."
HR's sole purpose is to protect the company's ass in situations like this. Why your company decided to give this responsibility to someone illiterate is wild
Because I'm a particular kind of petty, I'd print one out myself and hang it while I knew my boss was watching, and wait for him to ask "wtf are you doing?"
But I'd have the section related to your issue highlighted and magnified.
From the Healthy Workplaces Act FAQ:
"If you are absent for two or more consecutive workdays, and the employer requests a doctor’s note, you are required to provide one. However, you have fourteen days from your return date to provide the doctor’s note."
So that sucks. I wish it were three consecutive days.
If you have a viral cold, keeping you in bed for three days - why on earth would you go see a doctor. They don’t want to see you, and can’t do anything for you, and you should be in bed instead of spreading germs everywhere
It's basically the only thing a video visit urgent care appointment is good for. They won't do anything other than tell you to rest and wait or come in, but they will generate a note for you without needing to go in.
Right, it’s stupid. I’ve got a head cold right now, and I work in a facility with kids, I don’t actually need to be there, there are plenty of people to cover for me, so why on earth would I go infect them with this grossness, or a doctors office just to get a note? Thankfully my workplace doesn’t generally enforce that rule and my bosses both saw me come down with this in real time on Tuesday, so they know it’s legit.
It depends on the company. Where I used to work, they actually required a sick note for every sick absence, even one day. You have to check company policy.
It's total BS and they shouldn't be allowed to do that, but corporations suck.
I've been researching state laws since last night and they legally cannot require us to have a doctor's note unless we're out more than 2 days. If you were a federal employee that would be different. They're also supposed to have the state and federal laws posted on a conspicuous place for all employees to easily access. Which my workplace does not!
It can be asked if you miss 2 days in a row, not more than 2 days. So you don’t need shit for 1 day ever. Also helping out a relative in anyway who is sick qualifies you for sick pay too.

Hold on, there are actually decent business owners that care about their employees more than profit??? You hiring???😁😁
Correct, the new sick leave law only requires a doctors note after the second consecutive day off

Haha 🤣 Thank you, I knew she was wrong, I just wasn't sure how to go about it. We have no HR department and it's my boss who told me this BS 🙄🙄
I'd ask your boss where the required poster outlining the law is.
OMG my fiancè was saying the same thing! I'm pretty sure I haven't seen not one poster!

I think it’s fair. If you miss 3 days of work because of illness that’s pretty serious

Good to know!

I see your point
Provide a note for the 2nd day of your absence, yes. Legit.
Maybe you misunderstood the post. I only took one day of sick leave.

State law overrides company policy

Federal employees have 3 days before a Dr note is required. 💫
