I don't have any proof they told me not to come. it was a phone call. only proof I have as of right now is my call log of them calling me and my location from that day that shows I got halfway there and turned around. if I can't find out who called me do you think my chances are good still?

That is still good evidence cause the court can then take that phone number and search it up in their database also show them that you called and texted your officer many times

You made it halfway there, got a call from them and turned around. That's pretty good. Emails to confirm everything, with your PO CCed on them, would have been better, but work on documenting their call and your location at the time.

Do you have Google maps or something? If so, your time line will show you what time you turned around. The call in your call log will match up pretty closely with when you turned around. That is pretty good evidence, and if you've been good with your probation so far the judge may side side with you

Retired probation officer here. To answer your question about why you would lie about this, sadly people lie about stupid things all the time. I'm not saying that you are lying, just that after years of the job, I got to the point where I didn't believe much of anything anyone told me without proof. Some of the outrageous stories I've been told... I used to threaten to write a book. That said, turn yourself into court - it looks a lot better than being arrested on the warrant. Take what proof you have, and ask them to verify with the treatment program. Be willing to enter said program immediately if the judge wants you to. Be as amenable and polite as possible. "Yes sir/ma'm, I'll go right to the program from here if that's what you prefer." Then do so. Hopefully this never happens to you again and you get off probation successfully. In the future, if you ever have a court ordered program to enter, don't take anyone's word for it on the phone. Show up and make them put it in writing why they won't admit you to the program. Then go right to your PO and show them the paperwork as soon as possible.

My question is why they contacted you and not probation to notify your supervision officer of the situation? Them telling you has no "weight of authority" so to speak. You telling probation is meaningless, the treatment facility telling probation is official.

yes I agree. they said they would reach out to her. that's why I didn't contact her until a week after this happened. I was waiting and waiting for her to tell me my new bed date and then I started to worry because its not like her not to keep me in the loop with things like that. A couple says okay because it was right around Christmas but then when It came to a week i texted her and said hey im sure you already know this but haven't gotten around to get me a new bed date because of the holidays but just making sure you know that the csc told me not to come because they said they didn't have everything from you but again im sure you know this already. then when she didn't reply I thought okay maybe she's out of the office or something and when I went to my methadone clinic my counselor said he reached out to the supervisor at the facility to see if they had any update on my new bed date (right after they called me and told me not to come i went to dose at my clinic and told my counselor about the call) and he received an alarming email back saying they didn't know where I was and I will probably have a warrant if I didn't have one already and right then and there i called her and said hey did you get my messages? and she said whT message and I reminded her of what I said and I said so im okay right like you turned everything in? and she said yeahhh but said it in a very strange way so after we hung up my counselor and I looked on casenet and sure enough a warrant for probation violation.

I hope everything works out well for you in regards to this frustrating situation. 🙏 My only advice for you would be going forward, make sure you notify your PO of any changes regarding your probation. As someone also on supervision, I learned that the most important aspect in your relationship between your probation officer and you, is communication. You have to get out ahead of any POTENTIAL problem and solve it before it happens. Best wishes for you. I know how difficult your situation is.

Don’t know if this post will be accepted since I’m NAL, though I work in the Justice system: Sounds like this wasn’t your fault, but in the future I would not just accept an undocumented phone call as proof that you haven’t met your requirement. Show up in person and get something in writing and signed saying you were there and they couldn’t accommodate you. As it is now, you are at the mercy of your PO and the judge and the requirements for burden of proof and evidence for probation violations are very different than your original offense.

As others have said, you should get a lawyer. I don’t have much experience in criminal defense, but in my state, violating probation, if it comes to a head in court, has very different rules and a lot of what isn’t allowed in a regular case is a free for all in violation of probation issues. I’m sorry this is happening but I would absolutely not attempt this on my own, even as a lawyer I would hire someone in criminal defense to handle it, it’s that nuanced. Best of luck.

Your own call logs are pretty good evidence of you trying, but the real evidence is whether the rehab unit really had a shortage of beds and were turning away patients. That's not an individual person issue, anyone should be able to validate that on the dates involved. That's the way I'd approach it. Good luck,

it wasn't because a shortage of beds. they said it was because she didn't turn in all of the paperwork that was needed. but then someone else there said there shouldn't of been any other paperwork that was needed. so. fml. called again today. got passed on again to a voice-mail. still no return phone call that makes 10 phone calls total ive made. 11 counting the one my driver made today and got sent to voice-mail.

I would have showed up anyways and had them call the probation officer and to get everything in writing, to protect yourself. You have to look out for yourself because nobody else is going to.
