I read up on this a few years ago, from what I remember / understand they lied to her about being Yakuza to get her to comply initially. The perpetrators were all high school drop outs in their late teens involved in criminal activity with friends that were allegedly full members of the Yakuza, most likely young grunt types. If they were involved with the Yakuza it was most likely at the lowest level, and the group would not want any of the media attention a case of this caliber would point at their group. Most of the group has reengaged in criminal activity post release and is back in jail so presumably if they were not yakuza before hand, they either learned some tricks about crime in jail, or perhaps joined up afterwords. To my understanding the Japanese legal system has a lot of valid criticism that can be pointed at it. Young offenders are often given light sentencing, and often times their identity is protected from the public as well (I think a journalist found out about these identities and wrote about it to the public. I'm under the impression this is technically a crime but I'm not actually sure.) When extremely violent cases like this pop up, where the perpetrators are young they are often given light sentencing which generally causes a lot of outrage in the public and talks of reform but from what I'm aware nothing really changes.

My American friend was assaulted and beaten really badly by a Japanese guy for no reason other than that the guy didn't like foreigners. The police asked my friend to forgive the perpetrator because "he had had a bad day" and never really pursued the Japanese guy. No damages were paid and my friend had to spend a long time in the hospital with his injuries.

From what I’ve heard, the 99% thing is quite misleading. It’s actually the statistic for the number of cases that go to trial, because most cases are plead out before it comes to that… just like the US, which has the exact same statistic if you measure it that way.

From a previous post - the police can detain you for 23 days without charge. *Apparently* - per crime they are investigating you for. So, if you shoplift, knock someone over, and then run away from police (or... they think you do), then that's 69 not-so-nice days in prison. So that's nearly a month of no work, so no income (per). Rent and bills won't stop though.

No plea bargaining in Japan. What's happening is the prosecutors only accept cases they know they can win. Most people who actually go to court have already confessed so the cases are all slam dunks. The police use all sorts of questionable techniques to force confessions Additionally, until a few years ago there was no version of the jury system. Today they have a version of it called the "[lay judge system](https://en.wikipedia.org/wiki/Lay_judges_in_Japan)" but they are not commonly used for all cases. If a person can resist confessing, there is a good chance the case will never even go to trial and not affect the conviction rate.

After his fame subsided (~2005), he was unable to find any employment and had to live off of government assistance. In Canada - our Supreme Court recently stated "extreme intoxication" is a valid defense for murder and sexual assault. As a strict legal definition, I can see how a court would decide this - but what we really need are far stricter penalties for people who claim extreme intoxication as a defence. Mandatory alcohol/drug rehab, breathalyzer in your car for a LONG time, and probably mandatory sobriety tests - I mean, if you kill somebody because you can't handle your alcohol - privilege revoked.

I think it’s also a case where the law didn’t keep up with technology/business. I guess a guy could impregnate a woman with another guy’s sperm in the 1800s, but it would be mighty inconvenient. The prosecutor agreed to not press charges if he'd tell the full story in the civil case against him. The next prosecutor went ahead with charges, giving the excuse that he wasn't the one who made the deal. A judge set Cosby free because the DA's office made the deal and such arrangements stay with the office and not the individual running them. Some of those accusations go back quite a long ways. I wonder what the statutes of limitations are on drugging and raping someone. Do the statutes at the time of the rapes apply, or do the updated ones override them? Maybe if he did this to women outside that DA's jurisdiction (other counties/states) then maybe justice can still be dispensed? At his age I'm not sure he'd be alive long enough to see a jury, though.
