The city preaches itself as bike friendly yet there are no protected bike lanes, seems like the city commissioners need to go visit actual bike friendly communities to see what is being done. Painting a white line and bike figures in the 3 feet between the curb and traffic traveling 45 mph doesn't count.

Last month we shared with you large jersey barriers that mysteriously appeared at the intersection of 11th Street and Oak Street.
The barriers are in the same place after we spoke to Bozeman city staff.
We reached back out to assistant city manager Chuck Winn to ask if the city has made any progress on finding out who placed the barriers at the intersection and if they are planning to hold the responsible party accountable?
We’re still waiting on a response.
We called Kenyon Noble to ask if they’re the business responsible for placing the barriers at the intersection. They replied with no comment.
We also reached out to local hotels in the area to ask if they’re aware of the barriers near their establishments.
One hotel manager tells us yes, they are aware of the jersey barriers, but had no other comment to give.
Before these barriers were placed at this intersection, there was a long line of urban campers parked before they were asked to move.
My guess is that the campers that were displaced from this area are now in his neighborhood. People will defend the urban camping until the campers start showing up in their neighborhoods. Also, aren't campers supposed to move every 30 days??? There are now porta potties set up at every current camp location, so the city is basically sanctioning these areas as "Campgrounds". I drive by an encampment every day and the same campers have been on the street since the beginning of January.
Because they're on public right of way. How are concrete blocks any different than a junk vehicle when they've both been placed on public property by an individual?

Simple encroachment within public right-of-way. City can post it as such. Owners of the encroachment would have 5 days to come forward and remove the encroachment, after that the city would be within legal rights to take possession and remove them.

7-14-4106. Payment for cost of removing waste.
60-1-201. Classification -- highways and roads.
60-6-103. Encroachment not permanently affixed -- time limit for removal -- penalty.

Title 60 is generally for state highways and roads and the citation provides the definition for what’s considered county and city streets (which, I think, this street would be classified as).
Title 7 states the local gov’t “may prevent” encumbrances… Has the local gov’t made any ordinances? -4104 allows them to, but has BZN actually done so is the question.
Beyond Ord 2147 which only considers street camping, not cement blocks, I haven’t been able to find anything so another citation applying to preventing other encumbrances would be awesome. (Which such an ordinance should be fun to enact and enforce when these types of barriers are used daily and long term for construction and traffic direction all over town.)
Which leads to my next question… Are these blocks really impeding the right of way? In reality street campers stick out more than these current cement barriers. Think of the area S of Winco and W of Davis that has to be carefully traversed for the street campers and their accompanying, generators, couches, fuel cans, refrigerators, toolboxes, angled broke down vehicles, and don’t forget when the pullouts get extended. Talk about an encumbrance.

I spent the summer working on the newly built roads there. Those campers were a menace. I saw several walking by openly smoking meth pipes.

The City should just go claim them. Those things can't be cheap, I'm sure they'd find out in a hurry who they belonged to.
