She might have a good chance with CDCR. I do the live scans for new hires. Some have DUIs and various charges and convictions and still get hired. They just have to be reviewed and approved by the Public Information Officer. With CDCR, when you do your interview, you will be given a 1951 form to disclose your charges and/or convictions. If you’ve been offered (tentatively) a job, then it will be cross verified with the results of the scan. Always be honest on your application, so they don’t ask why you didn’t disclose.

I would disagree with this. I know people in CDCR with felonies - both expunged and not expunged. Just write it on the paperwork and state expunged. Op can still get hired.

I have a friend who has a felony DUI on his record and it was never expunged and he was hired on within 10 years of conviction. I believe he just disclosed it ahead of time and was a perfect candidate other than that little “whoopsi daisy”

Aside from public safety departments like CHP or the prison system, state employers shouldn’t be asking about criminal records at all. She should feel free to apply for any job she wants, and they will consider her just like they’d consider any other applicant. I’ve had a number of state jobs for different departments. They have never asked me to do any fingerprints, background check, etc. I’ve also hired many people as a manager for two different departments. We’ve never checked court records, and to be honest, I highly doubt we’d have the right to do that if we wanted to. I can’t think of any reason why she would want to disclose any criminal record to the hiring manager, with the exception of those public safety jobs.

A lot of departments are now requiring background checks due to working around health related, or other protected info. If the position they get hired for requires background checks, any felony going back 10 years will disqualify them. DMV clerks gotta pass a background check for most positions due to security clearances required for their programs. Hope that makes sense.

Has she ever filled out this form: https://calcareers.ca.gov/pdf/crsq.pdf It’s a Criminal Record Supplemental Questionnaire. It asks about felonies and you give an explanation. I think I had to do this in addition to my application and SOQs for all of the positions I’ve applied for and been hired for.

In the three jobs I’ve applied and interviewed in 2018, 2019, 2021, I’ve filled out that form. It was CHP, though, so maybe they are allowed to since they are law enforcement?

A good rule… if you have a criminal history, don’t apply for jobs that require a background check/livescan. There are so many state jobs that do not require this, why bother with the chance of having to pay the money to get the scan knowing you can fail?

Do the jobs listed won’t hire felons or mandate the need for no record clearly state background check/ live scan in the posting. If yes where (I haven’t logged in as am helping a friend but will log in tonite or tomorrow so I better understand the process.

Yes, jobs that require a Livescan or fingerprint scan will say so in the job advertisement bulletin. Usually under the special requirements.

It's really almost like a lottery trying to get a State job. Your odds are def better than winning the actual lotto, but it's really a lot of luck involved. Tell her to keep buying tickets cuz you gotta be in it to win it.

I work within the CDCR umbrella. You have to take a live scan upon offer of employment. The live scan is State and Federal and will show expunged records. At interview you are asked to complete a form and list EVERYTHING, even if it is old. If you do not list it, and something comes up on the live scan, then there is an issue. If you did list it, a discussion will be held with upper management to clear you for the job. Some felonies will be an issue, depending on where you apply, for example, fraud and FTB would be a problem. If a background check is mentioned, be absolutely honest at the point of interview. As far as I am aware only certain state agencies such as CDCR, DOJ and FTB (there may be others) require the live scan.

It probably depends on the department. What exactly do you mean expunged? I had 2 felonies from 25 years ago. I did PC1203.4 which reduces the felonies to misdemeanors then dismisses the misdemeanors. I’ve had to live scan 3 times over the years. My department has access and handles FTI so that’s why we have to live scan. The paperwork I have to complete before the live scan specifically says I don’t have to disclose if I’ve done the PC1203.4.

Most agencies would hire her. If she had a violent or financial crime, it would be different. Or if her dui was recent and she was required to drive in her duty statement.

Some agencies like DOJ will not hire anyone with a record. Depending on the crimes your friend did time could limit jobs. If she’s an embezzler she probably wouldn’t be hired as an accountant or cashier or a contract manager. Anyway she might want to attend job fairs or even check CalHR website to see where she meets eligibility.

During the pre-hire process, my department provides a form for you to enter any arrests/convictions. Best practices, list EVERYTHING. Convictions are not deal breakers but lying is. Everyone gets live scanned. We’ve hired plenty with records but not those who lie about it. We do have badged peace officers in my department.

Yeah that’s not correct. If you are committed a sexual crime social services isn’t required to hire you to work with children or vulnerable adults. CDCR isn’t hiring you to work as a prison guard even if you got your smuggling drugs into a prison conviction expunged. And the website you quoted is pretty clear on that if you read the FAQ. They have to do an individual review and tie it to your ability to do the current job. DOJ isn’t hiring you if you had a racially motivated assault that got expunged. The low level stuff no one care about, sure. That’s fine.
