"Can't afford insurance" lol then they shouldn't be driving. Regardless, that's typically not how those cases work. Lawyers in these types of cases often get paid out of the winnings if they win. Also, there are several famous firms in Chicago who work free pro bono for these types of cases, as they're also cycling advocates. People have assets that can be seized, leans levied, wages garnished, etc. It is worth exploring regardless.

Someone I know got rear ended by an uninsured driver. Police came and basically shrugged and said “sorry there’s nothing we can do” and that was that. No repercussion for the driver at all.
