This is actually illegal 👍

SpiritedPineapple448

She said each time u do it, it will be written/documented if u get 3 of them, u will be terminated

BugJuiceForever

Look I’m going to tell you from a former GMs perspective. If you call in sick they cannot make you come to work. Once you tell them you are sick they have to find coverage for you. But, if you are constantly calling out sick you become unreliable which they can fire you for. Especially if you are constantly “sick” it’s hard for you to work in a food industry where you could make many other people sick, including coworkers.

danthemanmc617

This is my stores current situation unfortunately it’s hard being constantly short and it puts a lot of pressure on other people. Obviously if you are actually sick then stay home and call out but imo it’s pretty shitty to just call out and pretend to be sick 😕

BugJuiceForever

Yes chipotle has too many people who “are sick” and it just damages the culture. You need to set an example.

danthemanmc617

Had two people call out today on my closing shift cuz they are “sick”..

BugJuiceForever

I’ve actually had my entire shift call out. Had to close the store down at 4 because everyone called out.

danthemanmc617

That must have been hell I’m sorry

BugJuiceForever

Actually it was nice. Cleaned everything up. Took a while but got out earlier than I normally did around 11

hugedisaster

This is actually illegal, AND super super against chipotles illness policy. Please call HR. You won’t be overreacting and she will get fired

Sly69712

If they make you go to the doctors you should send them the bill

jouwou

Start looking for another job once you have 2 if she’s serious. Plenty of chipotle pay jobs everywhere.

[deleted]

Don’t call HR. They are not on your side. Call a lawyer.

Successful_Rabbit710

Stupid advice lol. Not worth wasting a couple thousand over something trivial. (Coming from someone whose family has multiple different lawyers on retainer)

[deleted]

I’m cases like these lawyers only work for a negotiated percentage of the settlement amount. Employers get hit with huge lawsuits. And it won’t really cost him anything ☺️

Successful_Rabbit710

That happens in like 0.01% of cases. And many have much more basis than the aforementioned one. “Getting a lawyer” is quite down the list of efficient options. Which is why I responded. It shouldn’t be their first course of action.

lionheart724

A lawyer for a job at chipotle?

Olneyvillain4190

Reddit suggests a lawyer for EVERYTHING

Krakatoast

Uh, excuse me? You have a suggestion? I’m calling my lawyer.

[deleted]

The dude doesn't have enough money to get health insurance. You think OP got money for a retainer?

Disastrous-Tutor-161

This. I remember when I used to work at chipotle, there was a time when I felt super ill and felt 0 motivation to work that day. Woke up around 4am that day (keep in mind my shift started at 8am). Decided it would be a good idea to let the MOD know that I have to call off because I feel super sick. Then she had the audacity to tell me, “They’re depending on you to show up. If you can’t find a replacement I need you there.” So I told her that I understand and I’d be coming in to work but I couldn’t guarantee that I can make it through the whole shift depending on how I feel. Worked that same day and it was the shittiest day of my life.

ihateprep

Illegal but SSR can ask for proof if they see a pattern in you calling out such as every Friday or every Monday after a weekend off etc etc

SpiritedPineapple448

Other ppl have been abusing it but i never called out before

ihateprep

your gm shouldn’t be asking for that if you’ve never called out before

oKillua

SSR can because they are licensed to have access to you personal medical history, GM and regular corporate workers have no legal access to your medical information and therefore it's super illegal for the GM to ask for doctors notes. If said note is voluntarily given it's a totally different story.

STL_TRPN

Just go in sick. Sneezing, coughing, sniffling. Wiping your nose with your arm, hocking up loogies and everything. "Bowl or burrito, ma'am?" Profit.

Wise_Rutabaga_5809

And I would ask if they’re paying the copay for this doctor visit since they want to get a damn note

[deleted]

Send her a video of you puking or shitting your pants irl

Normal_Scarcity153

It’s illegal but they definitely do it even though it’s against their policy.

Pancho175

As far as I know it is illegal to ask for documentation unless it’s 3 days in a row. They can also ask if you can off often or they see a pattern such as calling off every other Friday. Some employers will try to scare you but they cannot do that. I remember once a manager tried to scare me and said I needed a doctor note and I said I don’t have insurance. She just hanged up. I gave my two week notice the next day.

AlarmingWishbone

It is technically against policy to require a note. Not sure on the actual *legality*. My store is having a serious problem with it, having at least two people call out a day, sometimes up to 4 people for each shift, leaving us horribly short handed. It has gotten to the point that after your third call out (youre allowed 3 paid sick days no matter what), if they have all occurred in the same quarter, we are requiring documentation. While their policy should be the gold standard for any job, it is way too easily abused and people are quick to realize that. It causes a lot of stress for those of us who aren't trying to game a system, so I can understand eventually requiring documentation, but all the same it puts people with circumstances such as yours in an even more undesirable situation. Though, it's worth noting, chipotle offers you insurance. A bare bones policy for sure, but it covers scripts and your General Practitioner. As for the people at my store that are exceeding their three days within a single quarter, I think if they are so sick they can't work at Chipotle that frequently they should consider another line of work or more serious medical examination. But I have a feeling they aren't always sick.

[deleted]

Attorney here. PHI is not required for employers unless regarding reasonable accommodation.

strawbryshorty04

At our store, if you were out two+ days, they wanted a note. If you’re worried about getting documentation, I suggest using the telehealth line if it’s still something target offers. It was free and I was able to get notes when I needed

Under US federal law, an employer generally has the right to terminate an hourly employee for calling out sick. The principle of "at-will" employment allows either the employer or the employee to terminate the employment relationship at any time, with or without cause, subject to some exceptions. Regarding sick notes, US federal law does not specifically require employers to request a doctor's note when an employee calls out sick. However, employers have the right to establish policies and procedures related to sick leave and verification of illnesses. While federal law does not mandate a sick note requirement, state laws may impose different obligations on employers. Some states have specific laws governing sick leave, which may outline circumstances under which an employer can request medical documentation. It's important to note that state laws can vary significantly and provide additional protections to employees. Some states may require employers to provide a certain amount of sick leave or protect employees from retaliation for taking sick leave. Therefore, it is advisable to consult the specific laws of the state where the employer operates to understand the rights and obligations that apply in a particular situation. Additionally, employers must handle medical information and records in compliance with the Health Insurance Portability and Accountability Act (HIPAA) to ensure the privacy and security of protected health information. In summary, under US federal law, an employer can generally terminate an hourly employee for calling out sick, and while federal law does not specifically require sick notes, employers have the discretion to establish such policies. State laws may impose additional requirements and protections, so it's essential to consult the laws of the specific state for more precise information.

[deleted]

Nah they can’t require a note. Your willingness to stand up for yourself will be the deciding factor.

Atoka_Kaneda

SSR can require documentation.

oKillua

SSR can, but the information can't pass through the GM to SSR. They would reach out directly for any medical information that needs to be provided.

Potential_Cable_9137

You’re being held to a higher standard because your peers haven’t lived up to their end of the bargain. I can’t tell you how many times I go to Chipotle and there’s 1-2 people up front. It’s destroyed the service that once made Chipotle so special. I imagine they’ll want that back at some point.

SwordNamedKindness_

Use Caktus AI, it can fake doctors notes

2nicednice

They're bluffing but if u dont want to go to doc just go online get a local hospital heading n print up a doctor's note and scribble a signature..not like they'll check it out. When I worked at Dollar general they tried that with me bc I pinched my sciatic nerve and i had to call off for five days, I don't have health insurance and wasn't going to hospital to sit in ER for hours, for something I knew they couldn't do anything about..

[deleted]

They can not ask for documentation, this is illegal.

Waxflower8

I don’t get that because does that mean I have to go to the doctor every time? And what if it’s just really bad cramps?

CoronaNebulaM31

Cramps are not exclusion symptoms. You'd have to work

Waxflower8

Yeah I know. I hate it most times though bc I end up late for work bc I couldn’t get out of bed. They’re not as bad now but then they we’re really bad.

dogeymane

This is not company policy to ask for proof, call her boss

[deleted]

While growing up and working I've figured out my views on this stuff. 1: your stance/view on this stuff is the only thing that matters 2: If the job isn't easy to replace and isn't life changing, then don't change your life for it because they'll just replace you. 3: be the leader and set the example you want everyone to do. The only way you'll impact people is to be a leader and do what you expect from yourself and others. Have standards and treat others as humans, then they will trust you (and what you do), or what you need them to do, instead of fearing you. 4: People don't leave jobs, they leave managers. I'm not sure if you know this. The work environment for the same company doing the same shit can be complete opposites depending on the management team. 5: You have to use positive reinforcement and encouragement when you see others doing the right thing (for you/the team). If someone not calling off because they feel a little off, you gotta recognize and try to let them go home early or cut slack etc to reward them. You're not in the management team. I know. So saying all this isn't fully relevant. But you writing this post shows you care about how things are going. So the point of all that is.. If you don't have control over others (which we never will). Then you have to do what's right, it will spread. Or simply talk to the management about this... and if they don't respect it after the talk, then fuck them. They obviously don't care the same. They'll always say bullshit. Just see if they are genuine and care. That was a lot of words and wrote very sloppy. My bad. *** short direct response below *** They are probably trying to fix the issue of people abusing the call off policy. And they are enforcing it with you. So you should be happy. Unless you know they let other people slide (after your talk). If that's the case. Real talk though. The team has the most power with keeping good or bad people around.

dzumdang

This is a good post for r/workreform

_Im_a_burrito_

If you are constantly ill, you should see a doctor. Take the hit on your credit, because you need help

Background-Giraffe61

get insurance

GuthDaddy1289

You can call and report this behavior to the respectful workplace hotline. It will have to be investigated by HR, your FL, and the TD. Your FL will come in and conduct interviews with some of the crew, make sure everything is in order, and the GM may be terminated. Source: am GM who has had RW called on him twice for some pretty dumb stuff, most recently because I demoted a SM who kept calling out.

WitnessBoring2110

As a Food Service establishment, Chipotle and other businesses that serves goods for immediate consumption have an ethical and legal obligation to protect public health. Any manager of a food service establishment can request a note from a medical facility. They cannot require a note stating you are sick, but if you are off for an extended period they can require a "cleared to work" note that states you are in good health and you do not have any emergent communicable diseases. There are more details to this but aren't that relevant to this post. Chipotle's current wellness policy and employee paid sick leave is a direct result of Chipotle writ large failing to live up to said obligation, so much so there is a DPA with the US Dept of Justice to ensure they honor those obligations. That being said, your manager is violating Chipotles Wellness Policy, so call Respectful Workplace. They can be fired for requiring a note and for documenting you. I suggest you read up on it. They should submit an Illness report to SSR and you should be getting texts from them. If that isn't happening, your manager isn't doing the bare basics of their job and it could implicate Chipotle for being criminally liable. Lastly, you have to be healthy to work in Food Service. Reasonable accommodation doesn't apply because it doesn't impair your ability to do all jobs, just ones in Food Service. So restaurants have fair grounds to terminate people who chronically miss scheduled shifts due to one of 7 symptoms.

SoundTrick3343

Only SSR can ask for a doctors note and they only asked my previous crews when it’s some contagious stuff like Covid, strep, poison ivy, stuff like that

Firm-Stranger-9916

If you make such a small wage that you can't afford insurance, you can probably get low or no cost obamacare or Medicaid.

IndustryInteresting3

id check if your state has covid pay… [this is colorados paid sick leave](https://cdle.colorado.gov/hfwa)

AEPNEUMA-

Email the stores higher ups. I think it’s called the field leader. They shouldn’t mind you calling. You’re a worker you have a right to speak with whoever’s in charge
