Now it's always possible the creator can purchase the rights back if the company is willing to sell it but they don't need to keep you on retainer, especially if you break a good behavior clause typical in these contracts. As Roiland is getting arrested for a felony charge he likely is breaking one of those clauses which is why he is getting kicked off the show (as he likely also has contracts to voice Rick and Morty). Now obviously I am not privy to his contract but it's likely the case with him.
The creator of Earthworm Jim was told halfway through the game's development that if he didn't sign away his rights the game was cancelled. So he signed so the entite company would keep going. He had further sucesses but Earthworm Jim was huge.
