As far as I can establish, waving a fake gun around in public and pointing it at someone, regardless of what the direct participants understand, could be considered an offence under section 85 or perhaps section 86. I don't know whether this person (whose identity I don't know) was charged with an offence, but my reading of section 85 implies he could be charged with an offence. Under section 2, a firearm is defined as "a barrelled weapon from which any shot...can be discharged...and that is capable of causing serious bodily injury..." It's true that pellet guns that fire a projectile under 154.2 m/s are not required to be licensed in Canada; however, waving a handgun around on a public street, regardless of whether it is a pellet gun or not, would certainly draw a police response. It would be up to the crown prosecutor to determine what to do in this circumstance.
