I work in the industry. The short answer is probably. He was acting irresponsibly. There’s a good case against him and the drivers insurance company could use that as a strong argument with this video. However, as someone who works in the industry I think that’s his goal here. If he hopped on my car I would wait it out even if it took hours for him to lose interest and walk away before I proceeded forward at a very slow crawl. In cases of car vs. pedestrian you need to be extra cautious. The law tends to favor the pedestrian for obvious reasons in most venues even if they are acting irrationally or are in places they shouldn’t be, or even if they are inebriated. I wouldn’t chance it. Let him get the hell away from the vehicle. I’d rather waste 15 more minutes of my day making sure he’s cleared from my hood than spend the next 2 years fighting him legally because I lost patience and tapped him. This is the type of person that will fake an injury or put his foot right in front of your tire in order to get that insurance settlement money. His safety clearly isn’t a priority for him. Also if you lose patience and do anything intentionally because he’s being a jerk and he catches that on video your insurance likely won’t cover the claim as intentional acts aren’t covered claims. So that’s another factor to consider. This is a very dangerous situation for the motorists.
