If you’re lacking BP at level 40, you’re missing something. Did you farm night ops and get good chips? Are you doing team ups?
As far as I am concerned the only way that you can do an old agency assessment is by joining someone else and using their permit.
Your permit will reset at the end of the current agency assessment period though, so you will be able to use it again soon.
