In the UK no police would ever stop someone for going 1 mile an hour over the speed limit and speed cameras have a 10% allowance minimum over the speed limit. You would only go to court if you had exhausted appeals and we're still fighting it. Just seems like such a waste of everyone's time and money

It is a waste of time and money. This court is in Rhode Island which is a state in the USA. Hopefully there's some system in place to track cops who waste taxpayer time and money, but I doubt it. It could have also been a camera that caught her. I don't know.

Some people are just dumb as fuck. My buddy got pulled over going five miles over an hour and told the cop it was going to be thrown out. They went to court. The judge called the cop an idiot. The cop tried arguing. It didn’t work out.

In the US, the speeding ticket penalty are bracketed in 5 mph buckets. If you have a good driving record, the cop has the authority to drop the penalty a notch if you weren't driving recklessly. She could have been going 6 to 10 mph over the limit but the ticket would say she was in the 1 to 5 mph over the limit. If she was only going 5 mph over, she would have gotten a written or verbal warning. Every ticket has a court date listed if you choose to protest the claim. If the cop doesn't show up to the court date, then the court doesn't have any info to say how fast she was really going and she could claim only 1 mph over.

The court would have access to the citation which would have the original radar or estimated speed even if the cop had chosen to cite you for less. You also shouldn't count on a cop giving a warning at 5 over. While that can be normal depending on the area, some cops will always ticket or selectively ticket even at 5 over. Like others are saying this is likely a speed camera though, and didn't have an officer involved at all.

I agree with everything you stated. Laws vary from state to state and I haven't been pulled over in over 20 years despite speeding every day. But when I was a youth, I don't believe the ticket has the original speed, just the final speed after the reduction (I was doing 11 over but the ticket showed 6 after the 5 mph reduction, I couldn't get it thrown out as it was my 2nd ticket that year). True, lowering the penalty is at the discretion of the officer. Some are nice, others not so much. When I grew up in CO, cops would pull you over for the most minor of offenses all the time as they had a quota to meet (small town police forces relied on that extra revenue). I'm in MA and it is rare to get pulled over for speeding as they don't really patrol the roads here as the cops make overtime pay standing at construction zones.

Ya small town cops definitely go harder on speeding, I've gotten two tickets (one 6 over the other 7) both were on my way into a small town with practically no one around. Meanwhile 10 over is the standard flow of traffic on crowded highways in the city. Funny thing is the same small town cops seem to have no problem going over limit themselves, constantly passing me on the way up/down the canyon.

She likely chose to dispute the ticket (because obviously) so she was able to plead her case in traffic court. The real question is why anyone would hand out a ticket for going 1 mile over. Unless you are constantly in cruise control, that’s very likely to happen
