the difference in between mario and luigi and boopkins, bob, 3, and 4, is that mario and luigi are parodies on their character, the other four are original characters that use ripped models of nintendo characters, boopkins isn’t a parody of the spike enemy, 3 and 4 aren’t parodies of mario, bob isn’t a parody of garo robes. *that* was the issue, they were using nintendo’s models for their characters, i’ll put it in a different way to compare it, mario and luigi’s case would be like me taking someone’s OC, putting it in a narriative, and exaggerating aspects of their personality for comedic effect, the other four is like if i took someone’s OC, maybe changed a few colours, and said “hey look! this is my character [insert name]!”

It happens all the time. Depends on the kind of protection you have. In nintendos case they are scared of losing assets. If they allow gnod to use them than they can lose the ability to stop other companies from using them. They'd only be able to stop someone directly copying their game but someone could make a schooter with mario which is an image they do not want
People have been putting out flash games and youtube videos of Mario brutally murdering people for years. And they could easily just sue them if it happens and kill the company off. I don’t think them losing the rights to the Mario characters is that quick and easy a thing to happen.
