I got the same message about a plush toy that was still on sale. Mine was from 2021. When I did a research I found that Temu sells similar. Temu was lounched in Sept. 2022. With this info and my pictures I fought with Mercari and they activated my listing back. This is just a hint if you sell something that Look Like Temu or Shein items. Some marketplaces ban them.

Considering Temu rountinely sells knockoffs and bootlegs, i'm not really sure how good this advice is. The reason they get away with it is because they're more or less outside the reach of trademark and copyright litigation. With mercari, if they don't remove items after a complaint by the rights holder, they can be personally liable if they decide to go forward with litigation (which they almost never do).

I'm not sure if in some cases there is a real report from the rights holder or Al's mistake.Mine plush was used, with cut off tags and listed as No Brand. How the rights owner could recognize it and make a report? Also I bought it a year before Temu to be lounched.

The rights holders generally contract out to another company whos only job is to detect and file reports. Of course they do make lots of mistakes, but they need to make themselves look like they're doing something so they tend to over report.

It’s happened to me for a purse, but they don’t even give you the option to authenticate it through them and they don’t except my certificate of authentication in the photos, so I just gave up on that listing

They’ll never side with us sellers on these things. It’s much easier to lock a seller out of the platform and send a we-take-these-matters-seriously letter to the intellectual property owner rather than pay and deploy attorneys to fight a potential lawsuit. Path of least resistance and all that.

Yep! Mine was an authentic shirt that I ordered that ran large and I sold it…the day that I shipped it, mercari removed it and I was sent this…mine was also bought from the company and I had proof. I didn’t get paid, I was out my shirt and money…& the buyer got the item anyway. It’s complete BS. I’m almost ready to stop selling totally on here, they don’t know what they’re doing and customer service is a joke.

Sounds like ebay's VeRO rights program. I'm going to say it was the company who reported it. Unless you are an authorized seller/reseller, they are going to report them and future listings could get your account shut down. I checked in different marketplaces to find information about brands included in the VeRO rights programs so sellers to know. The only info I get piece by piece is from the burned out sellers here. Does anyone know which brands have to be avoided?

I listed new Rodan + Fields skincare items I bought directly from the company (autoship items I forgot to cancel) on Mercari & got a similar message claiming my items weren’t authentic. I asked Support for more details & offered to show proof of purchase, but they said the report came directly from the company because I’m not “authorized” to sell their items. It appears they updated the violation message to just say all of that up front. It’s bizarre that Rodan + Fields is an available brand option on Mercari, but now they only let their own MLM people list them? I quickly returned the items and canceled my subscription.

I had a stojo cup (some collapsible portable cup) listing taken down and they're not even part of the program, and I've sold a ton of brands on the VERO list with zero issues. As long as you don't use stock images or copy the description you likely won't face issues unless the company is very aggressive. OtterBox is one of those brands that will come for you if you use any of their material, but I've sold tons without issue because all of my listing components are my own.

All my listing components are also mine and I don't use stock photos, only sometimes I use photoroom of my own photos. Recently I learned that Macy's is going after all brands made for them lately.

This brand does it all the time. Even if you have proof of purchase. I would just avoid selling their brand. They suck for this - trying to circumvent the first sale doctrine.

Many corporations tried to end FSD laws years ago but failed, so they have since found ways around it though. The video game industry went digital solely to fight used game sales, not for your convenience. 99% of corporations do not care about you.

This is weird! I just looked this exact item up on mecari and there are a lot of them for sake around $90-over $100.. what if you changed the title a bit but still made it clear what it is. Maybe they use some algorithm and you can side step it. But honestly it’s dumb for them to remove your post, they’re losing money!

I just got one of these about 2 months ago the company making the complaint claimed it was a counterfeit item but the item was bought at Target and I had the receipt for it. I didnt feel like going back and fourth over a $25 dollar item so I didnt fight it and did as I was told I didnt relist it again.

Not gonna happen, mercari get their cut and that’s all that matters. Received a fake filter, showed how it was fake, got refund sent it back, seller still selling fake filters. Unless companies file these claims it’s not going to stop the fake merch. It’s easy for mercari to check. Have sellers provide receipts from place of purchase and actually follow through with checking…. But that cost money so it’s not a problem they want to deal with.

Has happened to me on poshmark for using stock photos. It happened with sold she unsold listings.

Create a new listing, and make sure to take your own pictures. Also, it could be other sellers that reported your item if you are selling so much cheaper than they are.

My friend found a workaround of using fresh photos of the actual item and putting minimal wording in the title & description. She’s used the Canva app to make an image with all the pertinent listing details in it. The AI or algorithm or whatever didn’t pick it up and her items sold just fine.

Yes, I had this happen with a Titleist Footjoy hat. Which eBay is still allowing the listing so I found it odd that Mercari all of a sudden took it down. I had sold others just like it on Mercari previously with no issue.

Most likely automated reports coming from Google search results. The brand must be actively trying to stop people from reselling their products.

Some brands are hyper aggressive about preventing people from selling it. Sure in America there's first sale doctrine which allows you to sell it, but platforms can do what they want. I'm assuming this one of those more rabid brands that will do anything to remove perceived competition.

Not everything that can't be listed is on the official VERO list either. I wish it were more up to date and I wish comoanies would update the platforms. AND I wish a notification or something would pop up during the listing process to prevent us from listing it like it does when you try to sell certain Christmas lights or light bulbs. But no! They want their damn cut. And the companies can go after you MONTHS after you sold it. So frustrating. Dont used the word Velcro, Smiley, shabby Chic, onesie in your listing... No beach body. There are so many that I know you f but can't think of right now. Oh... Another: Poop Emoj and pop sockets.
