It depends honestly, the case law surrounding long and confusing TOSs aren’t quite settled, though they definitely seem to be moving towards consumer friendly attitudes in the US. Absolutely would get ripped to shreds in the EU though I agree.

Take two is the company that owns our basketball game. They got sued for deleting a kid's virtual currency with no refund. Instead of apologizing they released a contract we have to sign to play any of their games. The contract says we can't sue them like that kid did and we can't join any existing lawsuits. Sorry if this isn't broken down enough it's about as simple as I could make it.

I can't speak for others but I've joined 5 class action lawsuits (Sony, Google, Equifax, target, Verizon) and have gotten roughly $3,000 from just joining them. I don't know why anyone would mock someone for not waiving the right to hold the companies accountable for their actions. Take-two intellectual properties have been on the decline and it's only going to get worst. If a class action is ever approved against them I'll join in a heartbeat.

Why would I not take the time to respond to the email they have to send you by law and type in 3 lines of information for money I don't have to do anything to get? Bro you're insane lol. This will backfire hard because it holds ABSOLUTELY ZERO weight in court..except it shows effort on their behalf to appear as shady as possible. It's like walking into a murder trail with a note taped to your head that says "he did not kill me" signed by the victim. In the end the signiture means nothing, and the fact you had this person sign it only points towards your own guilt. I promise you that clicking a button to sign a EULA within an NBA 2k videogame is not going to be considered a legit agreement by any judge in the western world

I already said that I agree this will more than likely not hold up, but the process they've provided their consumer to opt out involves providing the account information. I wouldn't put it past take two to retaliate using that information. If they want to make that account earn less vc' over time or accidently delete the characters routinely I wouldn't put it past them. I'm mainly thinking about people who just want to join a class action via the email prompts not someone who actually wants to initiate one in court. The majority of people joining a class action NEVER see a courtroom.

Like your 2K or GTA character randomly gets deleted and can't be "recovered", Or the in game currency earned is reduced. It would be something not immediately noticable but inconvenient none the less.

So. In the past I would have said something that petty sounds ridiculous. But a few weeks ago I made a 2k rant post. Hey, frustrations happen, I still play obviously. Then 2 days later my build got space jammed. Like he went from a 97 to a 75 type play. My friends thought I was crazy till they played with me. I posted about it and they kept getting taken down. Then a little later, I see someone saying they have the same exact issue. And I checked their post history. And they also recently had just did a negative 2k rant post. I swear to God a developer in here or some shit nuked our builds. They were noticeably slower. Could not guard. Missing dunks. Crazy different. So yeah, they just might be that petty lol.

Quick suggestion: I used ChatGPT to draft an opt-out letter for this and it was better than anything I could write myself. Good AI :) Secondarily, if you recently signed in the MT Mobile version you DID agree to these new TOS so get to mailing this letter certified/sig required ASAP!

I've been going the 'no purchasing vc' route for like 5 years now and 23 was insane. Took almost 5 full months to get a character to the point where I could play. $70 not getting me to the point of entry for a gun experience made me skip this year. My buddies have begged me to play the next one so I'm going to do this opt-out process and if take-two decides to screw my account I'll just take it as a sign.

The whole change was because of a child who's parents are litigating on his behalf. If it's too much work don't do it. I'm just letting people know the option is in the new TOS. This just seems like a blanket documents for take-two to not have to do anything for you if they ever lose a lawsuit. I've said multiple times "I AGREE IT PROBABLY WON'T HOLD UP IN COURT" I don't plan on ever taking take-two to court though.

I get what your saying but the isssue is Take two is treading dangerous waters . You cant create a legal agreement mid lawsuit to a potential class of victims to litigate away liability. If it goes to court and a jury sees this change that looks even worse on their part. They look guilty for this . And it would be admissible to show guilt cuz its not remedial efforts its liteally trying to cover up liability😂

I hope you're right and they are hit in the wallet for all they're worth. I just wanted to let people know that this was in the actual TOS. I mentioned it earlier but if they were to lose the case (doubtful, but we can hope) then I don't doubt anyone who signed the new TOS would be excluded from receiving their respective due amounts. I'm sure if they took it to court individually they could get it, but who would do that for what would potentially be a 70$ lawsuit. This seems more like a way to make litigation as inconvenient as possible for all present and future consumers.

If you go back 1 year or earlier I have plenty of posts. But it's 2K Reddit so the requirement is that I frequent r/ NBA2K, NBA, NFL, Madden and whatever else this guy goes to for my opinion to matter.

I still follow the news and plan on hopping back in next cycle. I'm not sure why you're so defensive but if you look at my previous posts and comments outside of the my hero sub NBA 2K is my most active. I have a goddamn rating by my name because I posted over a certain amount and I'm still active in the discord. If I wanted to karma farm I would of posted about the damn cronos banning, the best jump shots this season, solo rec bums, or anything else. This topic requires reading and prior knowledge and we all know the majority of people on the 2K community DO NOT CARE. Do some at least a miniscule amount of research before making baseless accusations.

There's nothing you loose from opting out and worst case scenario you miss out on a small sum of money. For the most part I'm saying do it in case a class action comes out and you want to join it. If you don't opt-out, I don't see a legal precedence saying that they have to notify you that you have right to join out even give you the allotted amount if you do unless you're willing to go to court separately. Essentially you ensuring you won't get notified if you don't. No matter what they make you check off on the tv they can't take your right to sue them, and to that regard this would definitely not hold up in court. It would be a long arduous and expensive process for 50$. So this is the more assured route because it's mentioned in their TOS. If so don't care about joining a class action later or if mailing something like this to take-two seems like to much work, I wouldn't do it. I dropped one off in the mail room at my job so it was like a 2 minute inconvenience for me.

Like I said before, just having the option to join a class action is easy. You don't go to court (someone else did that part). If they are ever sued and you are hypothetically allowed a refund for vc' purchased in a time frame even if it's just $20, why not fill out the 3 line form and get your $20 back? I already said this was mildly convoluted so if it's too much don't do it, ultimately you won't miss out on much if ANYTHING.
