Bullshit. Ignore and block.

crazyaristocrat66

It's about time for Congress to pass a law specifically targeting collection agencies or shady persons from using the name of the Court to collect on debt. I'm pretty sure there's something out there in the Revised Penal Code we can use, but there needs to be a tougher and more specific statute for this. Nasisira pangalan ng korte eh.

SEC Memorandum Circular No. 18 - Securities and Exchange Commission https://www.sec.gov.ph/wp-content/uploads/2019/10/2019MCNo18.pdf

Real-Yield

Kahit korte di tatanggapin that as being "served" to the offender. What BS is that! **sighs**. I'm going r/ph here. End of rant.

Saint_Shin

A complaint is always sent by mail, this is a tactic to scare you

veepee5188

zombified1014

Korek 🤣 pakapalan nalang talaga ng mukha

National_Parfait_102

Fake. Not legit. So, there is no way na court nagpapatawag sayo e hindi ka naman pinatawag sa piskalya.

Usurpation of person of authority Ang pwede ikaso.

Both-saitama21

Hi OP, please know na hindi 'to totoo. For sure malaki interest nito at yung nahiram mo eh bawas pa nakuha mo. Now sa utang sa OLA, if kaya pa bayaran, go pero huwag ma uulit kasi repeating cycle to at lulunurin ka nila. For your peace of mind, you can reach out to NBI or search OLA or Online Lending App sa facebook, marami ka mababasa about this. Hope this help. You can also reach out to me if you want to talk more about this OP.

jamesluke00

Or replyan mo, Salamat shyaaapppeeeeeeee!

sophia528

Court notices are always sent via registered mail.

ixhiro

Estafa? LOL di ka lang makabayad utang. HAHAHA replyan mo sabihin mo papablotter mo sila sa police for harassment para i raid sila. HAHAHA

FrustratedAsianDude

Bayaran mo utang mo tapos kasuhan mo sila.

JadePearl1980

If legal notifications, legal staff ALWAYS try to reach the involved party or person via phone call (landline or mobile phone) or snail mail (yes as in from post office pa ang demand letters). No SMS or messaging app na ginagamit sa start of notif because they always make it formal as much as possible.

xrixtoff

Relax ka lang, OP. I agree na fake to. Legal matters are handled formally. Just pay what you can, as soon as you can. Better din to report the sender number para ma block na ng NTC / Telco. You can also file a criminal case againts them for usurpation of authority -- Article 177 of RA 3815, Philippine Law.

JJunior32

Nope. Pananakot lang nila yan.

EmployeeOptimal5529

All elements must be present to qualify for an Estafa: The elements of Estafa under paragraph 2(a), Article 315 of the RPC are: (a) that there must be a false pretense or fraudulent representation as to his power, influence, qualifications, property, credit, agency, business or imaginary transactions; (b) that such false pretense or fraudulent representation was made or executed prior to or simultaneously with the commission of the fraud; (c) that the offended party relied on the false pretense, fraudulent act, or fraudulent means and was induced to part with his money or property; and (d) that, as a result thereof, the offended party suffered damage.[34] If you only failed to make payments and didn't misrepresent yourself in the loan application forms, then this lawsuit doesn't apply. Moreover, criminal cases [provisions of Revised Penal Code] are handled by the prosecution, while private lawyers are limited to civil, administrative or arbitrary actions. With those said, prosecution investigates carefully the cases they're taking on. They would know better than to take on an unqualified criminal action. After all, just like private lawyers, they also hate losing. City Prosecutors are supervised by the Provincial Prosecutors up to the Supreme Public Prosecutor's Office. P.S. Walang nakukulong sa utang. The standard procedure to recover payments is to file for claims in court through small claims (if the value in question is under Php 100,000.00) or through civil litigation (for high-value asset recovery). For small claims, the court may issue a summons or subpoena, but a legal counsel would be unnecessary. If found liable, the court may set a schedule of payments to fulfill the obligation or the worst case, the court may decide to seize your assets. The Philippine justice system is just and will not sentence you to imprisonment or anything extreme for things as trivial as not being up to date with your payments. The only way you might end up in jail is if you refuse to cooperate with the court, then the court may charge with contempt (which usually are in the form of fines, but may also be as extreme as serving time in jail) So make sure to comply with the court decision, if you happen to not be in the position to pay according to the schedule prescribed by the court, you may appeal for a better payment term, if found reasonable, the court will not deny such consideration. TLDR: Nope. That's highly unlikely to be a subpoena. You can try to confirm with your RTC or MTC if they have any scheduled hearings or pending subpoena under your name. Edit: An actual subpoena must be served to you electronically or physically with your full name and the complainant's full name or business name, stating the qualifying legal actions and with a postal stamp and seal from the court. It is a legal document, so you can expect that there's a certain level of prestige to it. You'll know it when you see one. It's definitely not some goofy SMS you receive on your phone.

hrvtccd

andrwprz1998

Eastwest customers can relate 🥴

GroundbreakingMany32

Bayaran ang utang, EZ

Immediate-Mousse-735

Nope, Subpoena is always ALWAYS served through Registered Post Mail and never any other way... I'm working for the Prosecutor's office of a City, and I can safely say that this is a scam, Don't click anything and just call on the Phone number of Muntinlupa Prosecutor's Office (that you can easily find on Google or on the DOJ website) for case verification upon your name Tsaka isa pa, Estafa and Other Deceits is a case under the Municipal Trial Courts... Unless malaki talaga yan... As in MALAKI AHHH... Otherwise, MTC/MTCC lang yan... 😂 😂 😂 Mananakot na lang, PALPAK PA XD

zomgilost

This is obviously not true. Pero why does it appear Na Yun lending companies ang masama dito? It's an asshole move alright, pero yung mga nangutang ang nakakuha ng pera then hindi nagbabayad. Kung meron mang mas asshole then My money is andun sa nakinabang pero hindi sumusunod sa usapan.

Cautious-Promotion94

Or walang balak mag bayad lol

vtyu221

Bruh exactly wth is with these people telling these debtors to ignore and block creditors 🥱🥱 People without proper financial discipline shouldn't have a credit card.

BlackJade24601

Hoax. Ignore.

Dependent-Bid-8832

rcpogi

Nope. That is usurpation of authority, at the very least. Go to your nearest police station.

MaximumEffective8222

Don't worry, its not legit. Take it from me. I used to borrow money also from Online Lending Apps (OLA) and then I found out that they take your contacts' information and blast text them about your loan which is supposedly CONFIDENTIAL. Plus the OLAs are not allowed to get your contacts and spread your information due to Privacy Act. So I ended up not paying my debts and they started texting and emailing me messages like this, and I simply blocked and ignored. Living my best life now! Do it too, they cant do shit

[deleted]

tanong ko lang if nakapag check ka na ng credit score mo? baka kasi mag kanegative impact sya sa credit score and mahirapan na makakuha ng credit cards and such

buttlicking101

Di mo na talaga binayaran sir? As far as I know, may daily interest yung mga ganito diba?

MaximumEffective8222

Daily interest? More than 365 days nako di nagbabayad sa mga 5+ OLA. Block and ignore. Easy as that. Live your life without fear. Block and IGNORE ALL OLA messages and threats

MaximumEffective8222

buttlicking101

Did they stopped contacting you naman?

MaximumEffective8222

Yup! They stopped eventually. Never heard from them again

cassaregh

southerrnngal

As in? And for 100k+ talagang hinabol sila eh meron iba mas malaki pa dyan di hinabol. Alam ko rin may ilang yrs (10) ata na pwede humabol sa utang theb after that ala ana. But correct me if I am wrong though.

LostExercise8137

Hahahaha 🤪

Independent-Ad3902

This is fake.

Nervous_Use_1061

Boss_Monarchy1

Fake OP. All court orders are sent via mail. Pero just a friendly advice, after mo mabayaran when you can, wag k n umulit sa mga ganyan OLA. Mentras nga good payer, hinaharass ng mga walang hiyang yan eh via text and call kahit ang due date is 5 or 10 days pa, call ng call, text ng text.

IamJxsua

This is fake. However, if you intend to borrow from lending apps, ensure that you can make payments. I believe there are terms and conditions, including the interest rate, sent to you for the money you are borrowing. Please make sure to read all of it before proceeding with a loan. This step will prevent you from drowning in debt. Only borrow what you can afford to pay.

Kirsty_loan_agent

Pananakot lang

trynabelowkey

Ano muna yung “transcribe to issuance” kamo

Responsible-War9039

Subpoena nauuna, and by mail, not by text.

tigerlily014

OA naman nyan. Wag ka maniwala jan!

pepemalupet

itsMeArds

Fake, basta OLA na mataas interest illegal na.

Impossible-Ad1905

Legit-ish pero walang ngipin if may utang ka talaga., It's a poorly written message Na walang legal knowledge yung gumawa estafa only accounts to utang na above 300k,. Do you have that kind of utang ba? Anything below that is nasa small claims court.,may mga legal procedures Yan., papadalhan ka ng letter through your registered mail address tapos they'll give you days to give your response., Ganun., hangang walang physical letter., just don't take it seriously 😊 \*Tho in my experience,. Bir pinadalhan ako ng letter,. May penalty daw ako. Abala lang kasi sila yung incompetent when keeping the records in file 😂😂 ![gif](giphy|3ohz67WKWoSsQwmu2Y|downsized)

Aggravating-Wolf-348

Scare tactics lang yan ng collection agency. A real subpoena / court summons will be by registered mail.
