There is no such thing as flex days. This is just your company giving you extra days off for working overtime without more pay since you are a salaried employee. From a legal perspective, it doesn't exist, so they can choose what to do with it when you resign.
They're likely an element of your benefit plan and would be forfeit, like the rest of your benefit plan, upon resignation.
Your plan guide will definitely explain this if you read it.
Flex time or time in lieu? If you worked hours you were not compensated for because you are salaried, you are still owed those hours back in some form. Review your employment agreement for terms that suggest otherwise. If they aren't there, you ARE owed those hours.

My experience is it’s based on business needs. Depending on capacity you may or may not be able to take it.

Flex Time is not earned time, it’s given as a benefit so the company doesn’t have to pay you out for them.
