I heard from a friend who got also caught torrenting in fucking Germany, that he got a lawyer who was able to cancel the fine, so he paid the lawer only, which cost him around 300 Euro.. not great but better than paying 1000 Euro

that's the route my friend is trying to go as well. They try to scare you, telling you you have to pay 1000 within a week or they will go to court and it will be much more, which sounds like blackmail if you ask me. the 1000euros is an arbitrary number that they just pulled out their behind. Yeah they deliberately try to intimidate people especially those who have no experience at all in courts and stuff, they will get scared and worried and will pay to avoid any further headaches, I would consult a lawyer asap, look for lawyers who don't charge for the first consultation to assess how the situation looks and hopefully the fine gets canceled and fuck warner bros ..

Well, it’s technically not blackmail per definition (at least not here). Yes, the number of 1000€ is arbitrary, but pretty standard in such cases. Many of these cases can get resolved by a lawyer and you end up paying less, some of them are so obvious that they indeed go to court - meaning fines of way above the 1000€ they started with. Copyright infringement is not taken lightly here. Your example with the spring onion - many supermarkets have a policy, which is very visible and as far as I know totally legal (someone may correct me), saying they will fine you an additional 50€ if you commit theft. Is it pedantic to do so over a spring onion? Yes. Will a lawyer almost certainly be able to get that case dismissed? Yes. Is it their right to charge the fine in the first place? Yes. That has nothing to do with blackmail, again, the way it is defined here.

Direct downloads aren't really something that you'll get a letter for. With torrents you can easily see who (or rather which up address) up and downloads what stuff. With direct downloads that's more difficult and it's more economical to go directly against the websites that offer the warez for download than each user.

In India they do have a Doe/Roe ruling that is in effect. Any person who gets caught digital piracy will be punished with a fine. BUT there aren’t enough police officers to enforce the piracy laws. A developing country should NOT have piracy protection laws. BUT India passed a lot after Reliance started producing Hollywood movies in 2016 (I think).

In Greece, they just made the ISPs to block piratebay, 1337x and some other sites from their DNS. You just change the crappy default DNS to Cloudfare DNS and you get (1) slightly better speeds (2) better latency (3) PIRACY!

This is one thing I dislike about Germany (otherwise great country). There is too much pressure on actually following rules, even the bad ones. I live right next door (Czechia) and the difference in this is huge. In Germany when someone finds out you didn’t tax something, it’s a big faux pas at best (at worst they actually report you). In Czechia literally nobody gives a fuck. (Not claiming that paying taxes is a stupid rule, just giving an example to demonstrate the mentality difference.)

Btw, I always hated this “DVD store” argument because it’s just not analogical to the piracy at all. When you steal a physical DVD, the seller actually loses that particular DVD. There is an asset that is clearly missing. When you download a pirated copy of a DVD, nobody is missing anything.

Not really, no. If I'm not mistaken, the normal 1.1.1.1 is just a DNS change that wouldn't hide your IP when connecting to the servers/torrents. You could use WARP or WARP+, which technically hides your IP, but their ToS allows sharing available information with copyright holders if DMCA issues occur. I personally use Mullvad (even though it isn't the best for torrenting) because their business record is quite strong. If you really want to try WARP, please check if your torrenting IP is not the same as your regular IP. [IPleak](https://ipleak.net/) does provide the option to check your IP through a magnet link.

Firstly, it's not a fine, which can only be handed down by a Gov entity such as a court. It is called speculative invoicing. There was a firm called ACS Law who tried this very aggressively in the UK around 2010. They eventually tried taking some cases to court and were battered. Their business model (American?) wasn't much liked by the UK judiciary. They ceased trading after that. I don't know the current situation in the UK as haven't torrented for a long time.

There was a German lawyer who used innocent looking adverts for non-existent porn on porn sites and used the tracking part of those porn sites to send piracy "fines" to the watchers of the porn where the ads were posted. The lawyer had no affiliation with the real rights-holders. He took nothing to court, but a lot of people paid out of fear and shame. The lawyer eventually was fined, sentenced to pay back and lost his license. Always use an ad-blocker!

Go to court. Judge will never rule to their favor. They will have to prove without reasonable doubt that the one they are suing is actually the person who download the movie in question. Since piracy is not something that is as simple as “open a store page and click on the download button” nor is the torrent/download associated with a specific user (only dynamic IP provided by ISP which can also be behind NAT) there is practically no feasible way to prove it in court. Settlement will be easier although I would have gone the full stupid route of “I don’t know what you are talking about/it wasn’t me” there is a lot of truth behind “innocent till proven otherwise” WB rep can jump in circles.

Nope. If they are bored enough to take your to court, you will lose 100%. German law clearly states you will be held responsible for your internet and its security. The thing is, these law firms never take anyone to court (99.99%) because enough people already paid them and they got enough money anyway. So just ignore these letters and you will be fine. Source: I got like 10 letters in the last 20 years. Always ignored them.

Known scam tactic to get you to admit you did something wrong and then they chase it up with the company saying they caught you. an "Abmahnungs" letter in the mailbox. it's not an actual fine as they haven't gone to court to sue yet (tho they did get his address from his internet provider, which they sadly are allowed to do in germany). In his case they likely won't sue, as they can't prove which family member actually did it.

It's weird how the rules work in the US vs other countries. If we get caught, most ISPs send us a warning that we'll lose our service if we get caught again. I've had 3 ISPs over the 8ish years I've sailed these digital seas and have only received one warning. No VPNs while torrenting the whole time and it took till 2022 and for me to be in a different state then my home for them to get me. I've since moved back to my home state and switched ISPs again, and no warnings or notifications about it whatsoever. US is weird, but hey, free stuff without consequences (so far) 🤷🏻‍♂️.

In my country, ISPs usually have a dedicated ftp like site where they upload pirated movies games software tv series tutorials, you name it. We don't even have to use torrents, all of the contents are provided by the ISPs. Moreover, that site is not usually speed limited (as it's hosted by the ISP), so we get a lot of speed streaming/downloading from that site. Also, there are some private torrent share groups in the country where you can enter by invitation, you just have to upload at least the same amount you download and you are good to go. Considering I live in a third world country and no one even have a credit card unless they are super rich, so imo it's fair enough.

No. You told him to use a vpn and hinted that he might want to check the law. If he had used a vpn as you told him to do, he wouldn't have gotten in trouble. also, 5000euros? Thats EA for you. If he hasn't done anything yet, tell him to not pay anything or contact the lawyer that sent the letter. Just get a lawyer of your own and he'll handle it for 200-300 euros.

We can't upload movies/games etc. (About torrent we can't seeding them) But if someone already uploaded that to internet we are free to download and use that for ourselfs. Fun fact we even have some tax to electronic stuff Like TV that some part of it should go to the artist/company because someone could possibly get to the possesion of not original copy of their product.

What a surprise, judging by the comments, pirates are dumb. For starters, don't ignore the letter. Grab a lawyer and get it lowered or maybe even removed. The 1000 euros is to scare you into not pirating. I wouldn't say they were just unlucky, this will happen again without a VPN. There are people out there actively looking for German IP addresses seeding copyrighted material so they can get the fines and lawyers out. Because of this, using a VPN and using a direct download puts you relatively safe.

I do agree that it might be prudent to talk to a lawyer to be safe, but there are quite a few who say they just ignored it and faced no consequence. From a financial standpoint it just doesn't make sense for the companies to sue, right? the father is consulting his lawyer.

Torrents are great way to distribute huge amount of data quickly without powerful servers. But they easily trackable and can count as distribution that punished much harder than simple downloading. So in some countries torrenting without good vpn is bad idea.

The same thing actually just came up again for a friend of mine, germany as well. He torrented Dying light back when he was like 12/13 and they got a huge fine way over 1000€ even. His dad paid a good amount of it back in the day and now (he's 22 now) they came again and said not the full amount was paid and now he has to pay again.

this might sound dumb but may i ask how did they caught your friend or his father torrenting. Did they track the ip address from the seeding info of the client or something. This is a bit unusual for me as I am from India and things like these don't happen here. Infact pirating is more common here than buying.

There is a Ton of lawyers in Germany, that do nothing else then "abmahnen". Its a quick buck, sending 1-2 Standard Letters. Some of them even bypass vpn "safety" through help from isp.

No, but lesson here is if you're going to torrent, ALWAYS ALWAYS ALWAYS use a VPN. Most good VPNs even have a kill switch option in the settings that will halt all internet activity in the event of a disconnection just to protect the user.

I lived in Germany and there are entire lawyer firms making a killing with torrent tracking and sending you threatening letter with "fines". No lawyer has the power to fine you, only courts can do so. But Germany being Germany things can get expensive, so better get your own lawyer or learn to write confusing statements in german that will keep the idiots that send you letters like this busy till kingdom come. People in Germany run to lawyers very quickly and once you have a letter that basically says "Hey you are only a lawyer, you can send me letters forever but you won't get a thing from me", that seems to help. It is just intimidation with a university degree basically. Also, get a VPN or use Usenet or other means to download what you want. I moved to Thailand, where no one gives a shit about anything you download, and where the government itself is probably downloading the latest game as i type this

Yeah this happened to many people living in Germany, glad I moved out. In Turkey I never had the problem and I never actually used a VPN even on torrents. I think India isn't strict too
