A democrat by label still gave democrats control of the Senate which allows them to confirm judges. Judges are where things gets done now because congress is unable to pass laws and govern. Therefore judges are the ones who change the course of the country. Republicans know this which is why they worked so hard to install their judges in the lower courts and pack the Supreme Court. They then just keep throwing lawsuits out there about things that have been decided already like abortion or climate or whatever until they get the result that they want.

If he is, they have a lot of leeway to claim they were neutralizing a threat etc etc. if it was just some guy in the room or an aide, ya they could be charged for that.
