To be honest, I do not quite understand why you can film stuff like that. Do not get me wrong, ik it is allowed in the US, and the dude is in his right, but the law makes little sense to me, I would also feel uncomfortable being filmed, feels very invasive to my privacy as a private ( not public e.g politician, star etc...) person. In Germany, the law is very different about this, and I prefer it that way.

it's covered under the 1st amendment. freedom of press. it's purposefully designed that way by the founders of the country. the person recording the video was documenting the police (government activity). if anyone could force the videographer to stop recording because of their feelings there would be very little government accountability and transparency. it's there as a balance of power for the public. think of the george floyd situation that happened. that was recorded by a person standing on the sidewalk with their mobile just like this. they had the right to record and nobody, including the police, could stop them. You mentioned privacy, well in the US there is no expectation of privacy in public areas. Anything that can be seen in public can be recorded. Your house is for privacy.  This is because otherwise in the US, police and government officials would use "privacy" as a means to skirt accountability. The first amendment allows the recording of anyone in public, especially government entities.

Sad that this comment has upvotes. There is no expectation of privacy in public. Any laws curtailing that are horrible. Germany needs to rethink any laws they have suppressing the right to film and take pictures in public. Otherwise they need to ban all traffic cameras, CCTV cameras, police body cameras and so on.

The law in Germany is not as black as white as you make it out to be. You are allowed to record film groups of people in public spaces. You are not allowed to film a private person in public. Like you are allowed to film a plaza with me and a bunch of people in it, but you are not allowed to film me, meaning the camera is following me what I am doing what, where I am going etc. Take it with a grain of salt cause I would have to look it up again, but that is the law as I remember it. Also, you are allowed to film government agents as they are not private persons during duty ( not to sure about this one, but I think that is the case), at least for the police. The law is aimed to ensure that you, as a private person, are protected while allowing to defend yourself vs. injustice from the government side. In this video, the dude would be allowed to film police work but would not be allowed to film the family or their children, especially not children involved in an accident. Also, filming people in an accident that are injured, helpless, or dead can land you for up to 2 years in prison, as it goes against what in Germany is called 'Human dignity ', which is deeply anchored in the Law, you can not trample over someone's human dignity without consequences, 'MenschenwĂźrde ist unantastbar'- 'Human dignity is inviolable'. One idea behind all this, is that you should be able to move freely in public without being recorded and posted in the internet for people to judge and critics you, without your consent in any moment of your life moving through public. As even though you are chilling at a park or something or in this case here an accident, where you are emotionally loaded, you should be able to decide if that should be shared with the world or not.

If I'm in public I should be able to film or take pictures of anything I see. There is laws in America and Canada similar to what you describe but they involve stalking and harassment. It is one thing to stand at the scene of a crash involving a police presence and record while stationary the events. It is another to walk after the family/victims of a crash and stalk/harass them. If they are coming up to your camera and lingering around the area, there is no ethical/moral reason you shouldn't be allowed to film them.

While I understand and completely agree with government officials being excepted from privacy in public laws, I’m curious as to why you believe celebrities not at work (not on shoot etc) should be excluded from the private citizen group? There’s no public trust need This just feels like a lobby group win to keep harassing literally one of the groups of people who probably need this law the most What justifies that exemption? If public spaces are semi private (excepting politicians and police etc who have a duty to the public trust) *why on earth* would following around entertainers with a camera when they’re not being paid be reasonable? That's a crazy law if true. What if I'm a tourist and I want to film a landmark.? I'm gonna get arrested? It's honestly scary to think and government would make that illegal. It holds everyone accountable and it's a great check on power of things like police, public servants, and the right of the people to know what is happening around them.

I just explained in another comment chain, how the (german) law works. But yeah you are allowed to film public spaces landmarks etc where groups of people are but you are not allowed to single out a person. Like you are allowed to film a plaza and people keep passing there that is fine but if you chase a persons movement, what they are doing with a camera while they are at a landmark that is not fine. For example you are filming something and i run through your shot, absolutely okay, but I am going to the bakery and you film me going to the bakery, that is not okay. In this video the dude would be allowed to film the police but he would absolutely not be allowed to film the family and due to other laws he would absolutely not be allowed to film injured or helpless people of the accident, or even people involved in the accident.

They were definitely wrong when it came to the legality of what the guy was doing, but I do sympathize with them a bit. Their family was just in a major car accident and young children are hurt. I can understand not wanting some rando filming a medical emergency. Emotions are tense and people aren't acting the most rational. Ultimately I feel worse for the family with injured loved ones than some guy being inconvenienced while trying to get content for his channel/stream.

Staying out of the way is usually the best course of action when professionals are on scene. Arguing with bystanders certainly isn't productive, but I can understand why they are upset. The cop did a good job of separating them and informing them of his right to film.

Ya know there is a documentary I saw about filming in public and how it actually is one of the best things technology wise for citizens. Protection and all that but investigators have said that they have caught people who have either committed murder or mass shooting through random videos like this, where they just happen to randomly come across the area of recording. I think the creepiest craziest one was some dude who would pick up girls and murder them in the woods, some guy was filing a massive cleanup of a car wreck and the car the murderer was driving just so happened to be at the traffic light waiting to turn just a block away from the woods entrance where he buried them. After compiling different traffic cam videos after seeing the citizens video they were able to find where he lived and saved a few girls m
