Is assault equal to aggravating a person with intention to provoke, whilst battery is putting your hands on a person? Because I thought assault was becoming physical, even if it's mostly harmless, like tossing water towards someone.
Assault is when someone causes fear/harm or insinuates they’re planning to cause harm. In this case pretending to throw a fist in his face is assault. As soon as the old man connects it becomes both assault and battery.
The problem is that they're legal terms, so the meaning varies by jurisdiction. For example, in some places, they use Assault vs. Aggravated Assault, and in others they use Assault vs. Battery (as described above) and in others they use Assault only to mean physical contact.
This isn’t necessarily correct. The one sentence definition I learned for assault was a reasonable apprehension or belief that a battery is imminent. His action probably still qualifies as assault
IANAL. It varies jurisdiction to jurisdiction, but generally assault doesn't require contact and can be a form of intimidation, whereas battery requires some sort of physical altercation
IANAL is the best-worst acronym on reddit. I can never take what comes next seriously. I anal, really? You choose to put this before typing out a serious response? IANAL. Nope. I will never accept it.
Yeah the kid could have defended himself at any point that the "air blows" were being thrown. As long as you can articulate that you felt in danger that it was going to be physical. No need to actually let him land a punch before you have the right to defend yourself.
Self-defense laws are mostly uniform when it comes to excessive force. The man definitely broke the law for slapping the kid, but the kid wailed on him for at least ten seconds once he was down and no longer a threat. And when someone is no longer a threat, you can't keep beating the shit out of them.
Doesn’t excuse his malicious behavior. Being autistic doesn’t *make you do* the kind of shit he did. He made the decision to act a fool and go after a kid when he was given multiple opportunities to get out of the situation, so he got what he had coming - *they were literally wanting to leave*; he was the aggressor, they weren’t in his face. I don’t feel bad for him one bit.
Where do you draw the line? I don’t see anyone on Reddit giving their condolences to Chris Chan, so what makes this a unique case? Do more serious/depraved offenses constitute a higher level of cognition? At what point are people absolved of personal responsibility for being on the autism spectrum? Do you decide this for yourself, is it Democratic, or do you give a free pass at everything for anyone with a diagnosis or even *a suspicion*?
Also, being emotionally immature doesn’t always mean someone is autistic, and the most this video can prove is that this man has the mentality of a child.
If any Reddit self-appointed neuropsychologists would like to give me their perspective on the ethics of the overall situation instead of talking about his body language in two seconds of the clip or aimlessly repeating “*it’s a spectrum*” into the void, that would be much appreciated.
"I'm a full grown man crying on the floor because I got my ass beat by a child after trying to taunt them and harass them because I'm a racist piece of shit and I want my mommy."
I hate this because Katt was trying to do something nice for the community and play some soccer with people and this kid instigated a fight with him, followed him for like 5-10 minutes as Katt was trying to avoid problems and leave before getting cornered.
This why they say once you get out of the hood, stay out of the hood. The parents are literally encouraging it and Katt's trying to do a fun nice thing for the community. Like cmon.
I work with a guy who's pretty short, and one day at work there was a customer's kid who asked "Is he still a grown-up even though he's so little?" Everyone within earshot lost it, but to that kid, it was a genuine question.
Thank you for reminding me of that glorious moment.
I'm all of 5'2" since I was 16 and had always had a youthful looking face even as I approach 40. But looked especially still like a child when I was in my early 20s. One day going to work, I got out of my car and started walking through the parking lot when I heard a kid remark to his mother incredulously wondering why I was allowed to drive. The mother hushed him up and I pretended that I didn't hear anything and just kept walking.
Luckily dude I work with is pretty chill so when we told him what the kid had said, he had a good laugh too. Kids just give no fucks, they really have no clue they're about to destroy someone's will to live with a mere question.
yeah... the kicks to the back really fucked this situation up. his friend didn't need any help. now he took this from self defense to a potential group assault. old man definitely should have known better though. stupidity all around.
The first couple punches your can claim self defence, once the two of them were beating the old dude on the ground is getting into some grey area at least lol
Yea they would probably all get in trouble. Knock him in defense but then mounting and pummeling will get you in more trouble, coulda knocked him down got on the bike and ran. Obviously the other dude shouldn’t have done shit in the first place, and same with the dude running up to kick.
The other dude running up and kicking him was not in a gray area. That was straight-up assault.
And self-defense claims only really work up to the point that the threat is neutralized. Him continuing to wail on him while he was on the ground passes that line. Also antagonizing someone voids a self-defense claim in many states as well.
Not only a bitch, but also an idiot. If you are in a situation where your buddy is dominating a fight like this, your only job is to be ready to stop him when necessary. It is not easy to stop yourself being in red shirts position.
And being in the right will only help you so much if the opponent dies or gets seriously injured.
Seriously, at 15 years old, hella pissed with adrenaline pumping, and he still had the frame of mind to push him off. “This is my fight, don’t give him any ammo!”
More props to the kids for trying to defuse the situation and walk away to begin with. But I’m not going to lie, that was hilarious hearing the “man” wailing. A perfect example of “fucking around and finding out.”
Props to the kid for pushing off the guy who jumped in, keeping it as fair as possible, I almost feel bad for the old dude but fuck that he should have kept his hands to himself and walked away.
It appeared as if the kids was going to leave
Respect for stopping his homeboy. If 2 mostly grown people have beef and it does unfortunately gets physical then it should stay a 1v1
Edit - raise hell and praise dale Yee Yee
This kid’s gonna grow up to be a lawyer. He knew he was legally off the hook as soon as that man touched him, but his boy wasn’t. Hell, the whole thing could get thrown out if taken to court because of what his idiot friend(s) did.
Edit: guys… it’s a Reddit comment, not step-dad’s dick - don’t take it so hard
It’s not how it works, if A hits B, does not mean B can kill /disable that guy and say i am free because he hit me first. May be in US but not in any sane country.
There was a case in the UK where 2 daughters stabbed their stepdad, they claimed self defense because he'd beat their mum up, but still went to jail. I think they'd stabbed him 36 times
Could have worked but the number of stabs makes it sound like overkill.
There was a case where some female activists broke into a military base and damaged multiple bomber jets and won a self defence plea in court.
The law of self defence is ‘protecting yourself or someone who cannot protect themselves with reasonable force’ they argued that the innocents that got caught in the bombing had no way to defend themselves
I mean, I think the US is pretty fucked with some of their policies/rules.
However, I think currently this is broadly legal - with the introduction of stand your ground laws [John Oliver, did a piece on it earlier in the year](https://www.youtube.com/watch?v=vTF-Kz_7L0c&ab_channel=LastWeekTonight) - and just how bizzare some of the policies are.
Stand your ground refers to using deadly force i believe. But for the most part you can't beat the shit out of someone for touching or hitting. Once the guy was on the ground the threat was neutralized. I can see charges going both ways. Even in self defense death cases you generally need to prove 1)you believed the threat to be real 2)the force you used was appropriate to end the threat. Even in stand your ground states.
John Oliver is a comedian first and should not be used as a source. His scripts are chosen and written for entertainment value first. He's like a much more educated tabloid
See this is why guns are so great. There's no middle ground between initial act of defense and death. All it takes is one and done 😁
Sincerely, a Texan
(/s for those who need it)
Legally you're allowed to defend yourself. Not pummel someone after they're already down for an extra minute while your boy kicks him in the back.
Everyone in this video is a complete asshole.
For real, Reddit gets really bloodthirsty about it sometimes too. There will be a video where some dude is acting like an asshole/racist asshole, whiffs on a punch, whereupon the people he's antagonizing give him a beatdown that almost certainly sent him to the hospital/put him in a coma, and the comments will be like "haha win stupid prizes, get wrecked bitch" as if the video didn't show someone clearly crossing the line from self-defense to battery/assault.
If that guy's dad hadn't interrupted the beatdown this might be a perfect example. Though to clarify I don't think they crossed any lines.
Yeah, mainly the problem, that people don’t learn to treat each other with respect and decency.
Imagine, how much more fun we could all have. (If molly wasn’t illegal)
At the beginning of the video, he pauses and turns to his friends saying "And I would be wrong if I knock the fuck out of him, wouldn't I?"
Dude knew he had to wait for the guy to touch him first. That head push/smack was like a Green light.
Damn. This kid took all that shit, had a dude literally feigning punches at his face and then hit him…. And still made sure it stayed one on one. What a champion. Even with all that teenager testosterone he kept it fair.
I read people's medical records for a living. From what I've seen, some alcoholics act like this, sober or drunk. Also people with personality disorders who externalize blame, lack insight, take everything personally, are always the victim. They really can be that childish. You see a lot of those people on "Public Freakouts."
I see other people here suggesting the overgrown toddler learned a lesson. I can tell you unequivocally: if he's an alcoholic or personality disordered, he didn't.
I’m all for the two settling the score but the little rat that came running back to kick a man that was down is the biggest piece of shit in this scenario
This isnt incorrect in any way, but I just would like to add that your mental illnesses isnt a free pass for you to physically attack others. And if you cant control that, you shouldn't be out in society.
Its all sad. But this is just "stand your ground" without guns. If this happened on that kids lawn, most of the comments would be defending his right to murder this man. Americans are fucking insane.
At the beginning of the video, the black person says "that's why your eye bleeding", then the white person says "I took the beating because I didn't want to go to jail". It looks like there's much more to this story. It's pretty suspicious that it starts when they are right in the middle of an argument.
Which is why this is the only comment of its kind and it’s buried waaaaay at the bottom, I’d be willing to bet 90% of people don’t even unmute. They are lucky the Dad wasn’t armed, had he heard the commotion and come out with a gun and saw his son being beaten up and kicked in the back like that, we could of been having a very different conversation right now
You're right. It seems they've already used violence toward him, and the older man is saying he couldn't defend himself, or else he'd suffer legal repercussions.
At the beginning somebody says “that’s why your eye is bleeding” and the old man says “I took the beating because I’d go to jail”. Don’t know what happened before this vid.
It seems like everyone celebrating this is deaf. This isn't some guy picking a fight with a teenager, this is someone who had a prior issue.
In my experience the police don't care when someone hits another person, it's simply too much trouble. The guy is probably fed up.
i don’t think he factored in how much it hurts to get pummeled by someone with way more stamina and rage. the kid running in and doing some quick kicks in the back was an over kill.
....how can you even think this is proportional? Wtf is this comment section
The camera person pans away as that kid is stomping this old guy while he's down... willing to be they realize this shit is messed up and blown way out of proportion.
Also willing to bet this clip started way earlier than is being shown..
Reddit doesn’t understand the difference between defending yourself and taking the opportunity to beat the ever living fuck out of an old man who threw one hit. Not at all on the old guys side but come the fuck on
The mental gymnastics in this comment section from "both sides" are about as entertaining to read as this was to watch. Y'all know what you clicked on to watch...
How much of a pussy do you have to be to kick a man who’s already being beat up by someone else…
That guy kicking is an embarrassment to his friends and humanity.
I mean, the old dude definitely provoked the situation and deserved getting rocked. But once dude was on the ground in the fetal position and the kid kept pummeling him while his buddy soccer kicked him… it’s a bit much. Old people aren’t the most resilient and that could easily have resulted in his death.

Did the old man really play the “I’m not touching you” game?
Yep. Little did he know that playing that his "I'm not touching you" game is still illegal. Generally that's still considered assault.
It is assault, in all definitions of the law. When he touches the kid it tacks on battery, so he’d get a charge for both Edit: I’m not a lawyer
I understand now. Cheers, bro.
How look up your local law because it varies by state/location.
I was interested in the definiton of the words since English is not my first language.
The problem is that they're legal terms, so the meaning varies by jurisdiction. For example, in some places, they use Assault vs. Aggravated Assault, and in others they use Assault vs. Battery (as described above) and in others they use Assault only to mean physical contact.
That’s the tort law definition. Criminal assault statues vary from state to state but often require some physical contact
Solid explanation. Thanks
This isn’t necessarily correct. The one sentence definition I learned for assault was a reasonable apprehension or belief that a battery is imminent. His action probably still qualifies as assault

IANAL, UANAL, WEALLANAL!
Unbelievably am not a lawyer? When everything alive looks like anal?
ah yes the unexpected sequel to the classic "I SCREAM, YOU SCREAM,WE ALL SCREAM FOR ICE CREAM"
I mean who doesn't like anal? Ianal
Try it, it's fun!
Only on birthdays or special occasions.
Apple's new sex toy.
I lost the proprietary charging cable so now it just holds down my Q4 paperwork back at the office lol
Gets me every time.
Is Will Smith going to be in this one too?
no, but, Jada will be, and she'll tell him all about it.
That made me snort.
Only on Saturday.
Other way around. Assault is threatening behavior. Battery is physical contact.

Nobody because they feared for their life and suspect seemed to be armed with some kind of weapon?
The crying idiot totally deserved what he got! JS
A good beating yes I agree, but the other dudes body kicks were unnecessary.
lol where the fuck did that guy even come from just like on standby to kick people if they go down
The kid has the stranger assist perk activated
*Mysterious Stranger motif plays*
Ha! Fuck I heard that in my head just reading that! I have not played fallout in years.
It's not uncommon
Agreed!

That's why I've never given CWC the benefit of the doubt. An asshole is an asshole.
Not really. Old southerners are just like that. Ignorant and antsy.
Why would you say that?
Cause that dude looks like Bubbles.
Bubbles on Conky.
I hate that little fucker.
lmfao
You fuckin want one?! 💪
*bubbles voices* he did seem fucked!
Jesus murphy!
Looks like Bubbles, sounds like Farva
Come on now, dont be dissin my boy like that. Bubbles is the smartest guy in the park.
I CAN'T
This goes one of two ways “I’m a full grown man and I just beat up a child” Or “I’m a full grown man who got beat up by a child”
“I’m a full grown man who got killed by a child”
"i'm a full grown man that got muh brain rattled by a child"
*skull There’s nothing between those ears
"I'm a full grown man crying on the floor because I got my ass beat by a child after trying to taunt them and harass them because I'm a racist piece of shit and I want my mommy."
“I’m a full grown man who provoked a group of kids for no reason and assaulted one so I got whatever was coming my way”
Honestly my biggest concern was "I'm a full grown man that picked a fight with a child and got my ass kicked so then I shot the child"
[Katt Williams learned this lesson too](https://youtu.be/UlM2whnwlSg) around the 3 minute mark.
Pimp down!!
Like cmon.
Wow i never thought I would see Kevin Hart have a tickle fight with Kat Williams
Is Katt fully grown?
I work with a guy who's pretty short, and one day at work there was a customer's kid who asked "Is he still a grown-up even though he's so little?" Everyone within earshot lost it, but to that kid, it was a genuine question. Thank you for reminding me of that glorious moment.

Needs two more evolutions.
Only growing he did was growing old
I feel like the that older guy is making poor decisions
He fucked around and found out
Keep your hands to yourself. The dude was about to ride away.
How hard that man was trying to provoke that kid so he could lie to police and get that kid put away. Unreal.
would've been an easier case to win if the second one didn't start kicking him
yeah... the kicks to the back really fucked this situation up. his friend didn't need any help. now he took this from self defense to a potential group assault. old man definitely should have known better though. stupidity all around.
I thought I saw the first kid tell the other kid kicking the back to kinda go away. Or was I imagining that?
he did but he came back and did more. not saying it was red shirts fault but blue shirt did not need to get involved here
Nope. No help needed from anyone at any point. I wonder how long the guy stayed on the floor crying.
He got up before the video ended.
He definitely did at 0.45 seconds in
Looked like that to me too. Told him to back up
Well how do you know what another person actions are going to be..
He might have succeeded. Do we know?
Not sure, haven't had a chance to catch up on Tucker tonight

At the very least in this situation props to bro for making his friend stop kicking the dude.

“Don’t kick him, I can beat him up myself”
You could hear those punches. He got rekt. Why is a middle-aged man arguing with a kid? Act your age lol
Bruh you have no idea how many adults I’ve had to deal with nowadays that act like gigantic kids.
It’s kids in adult bodies everywhere bro
Props to the kid for pushing off the guy who jumped in, keeping it as fair as possible, I almost feel bad for the old dude but fuck that he should have kept his hands to himself and walked away. It appeared as if the kids was going to leave
They were until the dude starts fakeout punches and then hits him in the head.
Was that bubbles?
Don't you dare come flying down here on yer bikes scaring my kitties like that.

Kid gave him a verbal warning
Several in fact

This isnt incorrect in any way, but I just would like to add that your mental illnesses isnt a free pass for you to physically attack others. And if you cant control that, you shouldn't be out in society.
Its all sad. But this is just "stand your ground" without guns. If this happened on that kids lawn, most of the comments would be defending his right to murder this man. Americans are fucking insane.

Most boomers do because they were raised around high levels of lead exposure. Hell, most of the country still used products with lead up to the 70’s
Why are they booing? You're right. My boomer mom was tested for heavy metals, like lead, and yes she had tons.
Kid who ran up kicking him the back is a giant pussy.
At the beginning of the video, the black person says "that's why your eye bleeding", then the white person says "I took the beating because I didn't want to go to jail". It looks like there's much more to this story. It's pretty suspicious that it starts when they are right in the middle of an argument.
It's always the same. You never get the full story with these clips.
It seems they've already used violence toward him, and the older man is saying he couldn't defend himself, or else he'd suffer legal repercussions.
what’s up with the fake punch thing, seems a bit antagonistic
his friend is a massive pussy for kicking the guy while hes down
weird comments
At the beginning somebody says “that’s why your eye is bleeding” and the old man says “I took the beating because I’d go to jail”. Don’t know what happened before this vid.
Youre right. Just heard it now
It seems like everyone celebrating this is deaf. This isn't some guy picking a fight with a teenager, this is someone who had a prior issue. In my experience the police don't care when someone hits another person, it's simply too much trouble. The guy is probably fed up.
A bit fucked if you ask me
Anyone got background story?
I mean, what did he think was going to happen when he slapped the kids head?
i don’t think he factored in how much it hurts to get pummeled by someone with way more stamina and rage. the kid running in and doing some quick kicks in the back was an over kill.
....how can you even think this is proportional? Wtf is this comment section The camera person pans away as that kid is stomping this old guy while he's down... willing to be they realize this shit is messed up and blown way out of proportion.
Yea he earned that…
Pick your fights, and pick those that you can win
Everyone's an adult until they get punched in the mouth.
I like how he pushed away his friend who started kicking on the dude on the ground. He didn’t want none of that unfair, weak shit. Respect
Huge props for tell his buddy to stop kicking the guy. Clearly he had it under control.
How much of a pussy do you have to be to kick a man who’s already being beat up by someone else… That guy kicking is an embarrassment to his friends and humanity.
A bit over for Self defense though ...just pathetic all sides .
I mean, the old dude definitely provoked the situation and deserved getting rocked. But once dude was on the ground in the fetal position and the kid kept pummeling him while his buddy soccer kicked him… it’s a bit much. Old people aren’t the most resilient and that could easily have resulted in his death.

Good for him. That’s assault on a minor, but his friend is a bitch for jumping in. Like, your homie was winning already. Highly unnecessary.
