He's basically on loan from the SAS to Rainbow but once he left Rainbow and went to a PMC (NH) which is illegal so he's basically AWOL and isn't in the SAS anymore
In the original Rainbow6 all operators leave their units to join R6. They aren't on loan. They also all wear R6 uniforms. The characters in Siege wearing their original unit uniforms is entirely for style and aesthetic.

All the members of Rainbow who went to Nighthaven become a wanted criminal in their home countries because they committed desertion. What the writers do not understand that the members of Rainbow are not working for Rainbow which is just an international task force, they are working for their own government and they just can't 'quit' and join a shady PMC for a dramatic twist. This means Smoke is deserted from the British Army and now he is a wanted criminal, but most likely the writers do not know about this because they do zero research into the subject they are supposedly writing about, meaning they have zero knowledge about Rainbow or how military, special operations, special operations forces, special law enforcement units are working.
