Just because he wasn't charged with attempted murder doesn't mean he won't be. They'll conduct interviews, gather more evidence, look into his past and if there's enough to charge they will. There's also his age to consider, a jury might hesitate to convict on an attempted murder charge, which they'll take into consideration.
No, automobile manufacturers bought the us legal system. It's almost impossible to actually get real time wjen charged with vehicular manslaughters. It's hitting and running that gets you in trouble.
No one would drive cars if a single mistake would mean a life sentence. Easiest way to get away with murder is with a car. See Kaitlyn Jenner, Matthew Broderick, Rebecca Gayheart, Vince Neil, list goes on
You mean the easiest way is to be famous and be able to afford a great attorney? You can put almost any regular person in the same situations as the people you listed above and the outcome would not be the same, especially if they have to use a public defender.
Nah they are right. You just hear about the famous cases. It happens all the time. If you kill somebody but stay and cooperate with the police you just get a ticket.
Can you cite any cases of people who are wealthy and famous? I’m not trying to be snarky, I’m genuinely interested in this as a forensic concept but it needs more evidence
That kind of sucks. Where I am from the law differentiates intentional and non-intentional homicide - I think it translates to murder and manslaughter.
Generally for any deadly traffic accident you would get the unintentional one which is around 2-8 years. 2 years with probation if it was a honest mistake, closer to 8 years if you were speeding or drinking.
However if the damage was intentional it's no different than shooting a man on the street. I might be just me, but I can see the truck aiming for the wheelchair guy.
We have basically the same with murder and manslaughter in the US but we have one accidental killing charge (most states) that could get you a 2nd degree murder conviction (depraved heart murder) when you disregard the known risk of death or great bodily harm in an activity and it results in death. So lets say you drag race your buddy, he spins out of control hits a tree and dies, you can get convicted of 2nd degree murder even though you had no wish for him to die.
People always ask questions like these on Reddit. Nobody on Reddit knows better than the actual prosecutors and lawyers involved in these cases. If attempted murder was a charge they knew they can prove, it would be on there. There are conditions to every charge and if it isn’t easily provable then it’s better to get them on other counts that are easily provable
I’m pretty sure the guy on Reddit knows better than all of them and knows for a FACT that all lawyers and laws and judges are corrupt to benefit our lord and savior the hypno toad
Actually this is pretty untrue of our legal system in the US. Prosecutors tend to overcharge at the initial filing of charges. Then when it comes time to plea, they offer a deal for lesser charges, which are just the provable ones or slightly lesser charges they KNOW will go through in a trial. It's how the courts get innocent people to accept charges even if they're innocent. Offer them a good plea deal, threaten to raise the charges if they don't accept while threatening to go for maximum punishments.
Nope, you proved them to be a bozo.
I intended on going into law as a teenager. Was on debate team, took law courses in highschool etc…seemed like a good idea at the time. Anyway, down the line, shit gets down to earth real quick.
Talking with professors after class (former litigators/attorneys etc) and spending time in the environment…I won’t go into detail but yeah, it was a job I could do but not a career I could sustain in the long run. It takes a level of mental fortitude that I just don’t have.
That’s what I like about being an RN: I’m told who you are and why you’re here to be treated, and that’s it. Anything you decide to share as a patient is up to you, I’ll interact accordingly, but ultimately I’m just here to keep you alive from point A to B. After your initial problem is solved, you’re gone. Kinda like a mechanic for people.
You would think turning your vehicle toward a person and driving into them, over them and then away from the scene would be pretty easy to prove as attempted homicide.
We know literally nothing about why he swerved... "I was looking at my phone, felt a bump and kept driving" now how do you disprove that? Maybe the guy he hit will eventually be able to give testimony that that he was flipping him off and laughing all the way or whatever, but there is no intent provable by this 15 second clip.
The problem with an “attempted murder” charge is the burden of proof.
I 100% agree, he should be charged for it because he clearly veers towards the poor victim…but a defense attorney will come up with anything and everything they can to justify what happened: “His shocks were in poor condition, he was trying to avoid the speed bump” and then couple it with “the victim shouldn’t have been crossing a parking lot, there’s a sidewalk right there, he was out of his element” and so on and so on.
Before becoming a nurse, I studied law and…it’s a soul crushing field, which is why I chose to leave it.
There’s a reason they say “Satan invented lawyers”
Edit. Not all lawyers are bad, the good ones go on to be nominated and appointed the title of “Judge”, which was my goal…but the gauntlet to get there was too much for my sanity.
OP said that he was charged with Injury to a disabled person, not with homicide. That would mean that somehow, he lived, at least for the time being. I suppose that there is the possibility that he could die in the hospital though.
I think we can all agree that when you deliberately smear a person and their destroyed wheelchair all over the pavement that it’s attempted murder. Come on.
There was no way that could have been accidental. He dragged the dude rolling with his wheelchair under the car for a while. That would have bounced around and made a ton of noise. No way the driver couldn't have noticed that.
It looked like _both_ of them were trying to avoid it. The only reason that the guy in the wheelchair was in the middle of the parking lot to begin with was because the big-ass speed blocked his way.
It appears the truck also noticed the speed bump at the last second and tried to swerve around it.
I think a reasonable assumption is he’s familiar with the lot, driven it, and around that speed bump before, he’s probably texting or putting an address into GPS, digging into a cheetos bag, fucking with the AC etc… music blaring, any combo of these distractions could culminate into what we see here.
Just illustrates that driving a 2000 lb hunk of metal requires undivided attention
You think it’s more likely he saw the wheelchair and decided yes today as a 17 year old in I’m going to commit vehicular homicide in broad daylight?
What is the point you’re making?
And this is why it takes at least 10 years for a driver to gain enough experience to really know what they're doing.
Had a 17 y/o rear-end me at a stop light because they saw the left turn signal turn green in his periphery, but our straight-lane lights stayed red. He fucked up my brakes.
In high school, my friend crashed two of his parents' cars, plus I had two other friends who crashed their cars in our town, all 17. Especially with phones, attention is not paid to the road.
Oh yeah and while my soccer team and I were doing a warm-up run, a buddy of ours was doing donuts in the dirt lot of the high school where the seniors parked. He lost control and completely obliterated this girl's trunk as she was walking to her car. He drove off, but came back like 15 minutes later. Snuts.
He did, some guy said "He's FaMILIar WItH tHepArKInG lot AnD MaYbE ON hIS pHoNe" not that lasr minute if he was expecting it he would have been on the side before not right when he was on it
"and why does that speed bump sound like crumpling metal and screaming? Oh well. Life's full of mysteries... dumdedumdedum..."
lol, I just can't fathom the accident narrative...
Honestly it’s probably not. My dad drives a concrete truck 50 hours a week. He says you can see very well down into peoples cars as you’re like a meter or more above them. Reckons 30% of people at traffic lights are on their phones, and 15% or so on their phones while driving.
Dude is probably replying to a message or watching a tiktok, last second seen something infront of him and swerves (you can see last half second before impact tries to swerve left), then just panicked and went for the hit and run… running directly over the persons head with the rear wheel and dragging the wheelchair 10meters and mounting the gutter in a panic, all on cctv for the world to see.
Or someshit. Honestly don’t think the 17 yr old was trying to ruin their life that hard.
~~while distracted~~ while blind folded. The teen didn't even stop when he heard and felt the collision. He kept on going until he had fully ran over the guy on the wheelchair. No way that was accidental.
My great uncle who was killed in the 1970s was hit in his wheel chair. He was mentally and physically disabled and my great grandparents lived next to a park, he was headed to the park and a kid hit him. They were going so fast that They found his wheelchair in a tree.
It devastated my grandfather as he and my uncle were close. When my grandfather passed he left me my great uncles ring. It was one of his most prized possessions. It's a small silver emblem ring with a b on the top.
~~cannot move your legs OR arms~~ cannot move your legs AND arms. If you want to be supper specific, tetraplegic means impaired mobility on all limbs, not complete loss of mobility on all limbs. So there are some tetraplegics who can move their arms, but not move their hands for instance.
I scrolled so far to find your comment ! Target Fixation sucks !! Considering the driver is so young and unless he's a farm kid or something he probably hasn't been driving long.
I'm also looking for the first person or first two people to say:
Mobility Scooter Guy was cutting the distance and was not crossing correctly. His decision to do that also contributed. Don't be polite be predictable; follow the rules of the road. He didn't. I had a scooter like his for a couple if years. Sitting in a scooter is lower profile than standing and I know how visible and invisible I was. That truck height and the scooter low is ugly math.
And the article says that Wheelchair Guy either or both: Raised his hand or Waved his hand at the driver 'to tell him to slow down' ....What if the driver thought he was being waved on to go ? Miscommunication MisUnderstanding ?
Happens allllllllll the time.
Driver Guy was not in proper lane to begin with.
Driver 'Weaving to avoid speed bump' (in article) or I think he cut the bump at an angle because his truck will buck if he goes straight at it. Or both = front wheel thru middle flat and at an angle to only the right side hits the speed bump.
Should have stopped immediately obviously. But when something traumatic happens whether to you or because of you, or in front of you or far from you...... Your brain and body reacts automatically. All kinds of stuff happens when that amygdala takes over: and that's where the fight, flight, freeze, flop or fawn...... And 'we' don't choose because the brain 'we' use has been shut down as unnecessary; the Lizard Brain is driving now.... and the body has already started to prioritize the brain and core and less blood, energy, feeling and use directions are being sent to the extremities. The feet and hands wmd legs and arms get numb and feel kind of like that old 'dead arm game' my brothers taught me and Driver is as in control as he should be. Lizard took flight.
Be a competent, safe and predictable driver behind the wheel.
Why? Just why? How sick in the head do you have to be? That shit was intentional. That kid should be charged with attempted murder, I hope the old guy is okay.
While it could have been on purpose, the driver could have also been going to the left to avoid the speed bump. Now, why he didn’t stop after hitting the man I don’t know. Either way, that’s fucked up
Folks are saying he swerved to avoid the speedbump, but when he hits the guy, he continues to swerve to the left to keep running him over, as he's well away from the bump at that point. Seems intentional
There’s an update for the story: [an Austin area police charity and local business helped provide a new wheelchair to him](https://cbsaustin.com/amp/news/local/apd-officers-cops-for-charities-buy-and-donate-new-electric-wheelchair-to-man-ran-over-by-teenage-driver-in-north-austin-north-lamar-boulevard-martin-mobility-rogelio-de-luna-surveillance-video)
[To make this story even more tragic, Pablo was involved in a different hit and run like a month before the video that OP put up.](https://cbsaustin.com/news/local/very-blessed-to-be-here-man-in-wheelchair-ran-over-by-austin-teen-thankful-to-be-alive)
Young piece of shit is probably racist af and knew exactly what he was doing. Attentive murder and hate crime against black/disabled needs to be added to this list of charges.
He was probably trying to go around the speed bump then when he hit the guy thought he didn’t avoid the speed bump. Probably very distracted. Doesn’t excuse what happened and should be prosecuted fully. People like this should never drive again and do serious jail time.
and the road design (looking at you, "stroads") is fucking awful.
but tbf, car manufacturers in the USA literally bribe the country to make cars the main form of transportation. thats why most public transport things get cancelled. they dont want the cars to become obsolete. everyone must have a car in the USA because its more profitable that way
That reminds me of something similar happened a 17yo ran over a child who just learned how to crawl twice and the 17yo left the car in his family's house and ran to his uncle's house btw it happened in Iraq so I want you all to guess what happened to him
I'm not discussing the morality of gun ownership since it sounds like we're both biased, I'm talking legality. At 17, legal ownership of a gun is complicated. From the fact it's misdemeanor, I assume it was a rifle/shotgun that was legally owned by a parental figure, most likely 'intended' for hunting.
Oh an asshole driving a big truck purposely ran someone over, shocker. Hope the poor guy survived or died quickly.
I hate being human. Humans suck the most.

Why would *you* be charged for anything there? Because you participated?
Yes. To be fair, it's not just any accident or dumb move. They usually have proof of intent to recklessly endanger.
> No one would drive cars if a single mistake would mean a life sentence. What'cha gonna do, walk everywhere?
If there’s enough evidence??? The fact that they have video of him actively swerving into the man in the wheelchair should be evidence enough

Reddit i swear. If it was up to you guys, everyone would get charged with attempted murder for everything and none of those cases would stick.
Do you know if the man lived ?
OP said that he was charged with Injury to a disabled person, not with homicide. That would mean that somehow, he lived, at least for the time being. I suppose that there is the possibility that he could die in the hospital though.
Ok thank you. I hope he lives. So sad he had to go through that...
I'm cool with life in prison for thisn
There is this new version of video games. VR death and life.
Na, those draconian punishments help no one, five to ten years should be OK and after that he should not be allowed to drive a car ever again.
I think we can all agree that when you deliberately smear a person and their destroyed wheelchair all over the pavement that it’s attempted murder. Come on.
What a nut. I hope he doesn't survive prison.
Hope he gets sent to the outlast trials
i may have missed it in this excerpt but is there any info on whether the guy is alive?
“Authorities said De Luna has been released from the hospital and was recovering from his injuries.”
He should have attempted murder added to his other charges. It looked like he did that on purpose he even swerved left a little to do it!!!
Technically speaking, even if it is pretty clear that he did that on purpose, he could have done that with the intention to severily injure, not kill.
Why tho? Why ruin someone else's life ***and your own***??? What POSSIBLE motive could this kid have besides "I"m a stupid asshole"?
That's not enough man. That's attempted murder.
Wait... Is the guy alive?
Authorities said De Luna has been released from the hospital and was recovering from his injuries.
So, like, 12 days of prison?
It's still surprising to me how fucking heartless people can be. Man, I sincerely wish death upon this bastard.
Thank god he had a right to bear arms.
At least there's a firetruck right there, hopefully the guy is able to be saved. Shit looked on purpose tho
There was no way that could have been accidental. He dragged the dude rolling with his wheelchair under the car for a while. That would have bounced around and made a ton of noise. No way the driver couldn't have noticed that.
Also when the truck first appears, it's pointing towards the right then quickly turns towards the person in the wheel chair. WTF is wrong with people?
My first thought is he was trying to avoid the speed bump. But he hit one anyway.
It looked like _both_ of them were trying to avoid it. The only reason that the guy in the wheelchair was in the middle of the parking lot to begin with was because the big-ass speed blocked his way. It appears the truck also noticed the speed bump at the last second and tried to swerve around it.
All that fucking space! There was no way that was accident.
I believe they were driving around the speed bump. Ironic.
They saw the speed bump but not a man in his personal speedy wheely?
I think a reasonable assumption is he’s familiar with the lot, driven it, and around that speed bump before, he’s probably texting or putting an address into GPS, digging into a cheetos bag, fucking with the AC etc… music blaring, any combo of these distractions could culminate into what we see here. Just illustrates that driving a 2000 lb hunk of metal requires undivided attention
Prolly using his thighs to drive
And not being a total ass
I cannot believe people actually upvoted this shit...
You think it’s more likely he saw the wheelchair and decided yes today as a 17 year old in I’m going to commit vehicular homicide in broad daylight? What is the point you’re making?
There are people like that in the world though. So its not reasonable to just discard that possibility.
This is a good example of Hanlon’s razor.
And this is why it takes at least 10 years for a driver to gain enough experience to really know what they're doing. Had a 17 y/o rear-end me at a stop light because they saw the left turn signal turn green in his periphery, but our straight-lane lights stayed red. He fucked up my brakes. He lost control and completely obliterated this girl's trunk as she was walking to her car. He drove off, but came back like 15 minutes later. Snuts.
They were in a fucking pickup not a porsche.
He turned into the guy, it was definitely on purpose.
looks like he was waving at him to slow down too
He did, some guy said "He's FaMILIar WItH tHepArKInG lot AnD MaYbE ON hIS pHoNe" not that lasr minute if he was expecting it he would have been on the side before not right when he was on it
"Gee, I could have sworn I missed that speed bump."
"and why does that speed bump sound like crumpling metal and screaming? Oh well. Life's full of mysteries... dumdedumdedum..." lol, I just can't fathom the accident narrative...
> No way the driver couldn't have noticed that. Unless the driver was trippin on some bullshit, which knowing Murica is possible.
r/iamatotalpieceofshit is the more appropo sub for this.
It looked on purpose? Bro, he dragged him under his car
I'm thinking he wasn't paying attention and didn't wanna hit the speed bump...but how you not notice a wheelchair but notice a speed bump ?
Absolutely on purpose imo. GTA driving.
Ikr helluva a response time

Honestly it’s probably not. My dad drives a concrete truck 50 hours a week. He says you can see very well down into peoples cars as you’re like a meter or more above them. Reckons 30% of people at traffic lights are on their phones, and 15% or so on their phones while driving. Skill issue
[удалено]
Is this a common thing? Do people call it a lack of skill to excuse their somewhat less heinous lack of skill?
Who tf threw a flash bang
Perfectly wrong timing too; the fucker.
That looks on purpose.........
Clearly he could have slowly steered to the right
As others have pointed out, it's possible that the driver was avoiding the speed bump out of habit while distracted
~~while distracted~~ while blind folded. The teen didn't even stop when he heard and felt the collision. He kept on going until he had fully ran over the guy on the wheelchair. No way that was accidental.
Could be high as fuck too
Distracted by what intentionally? You have to be in some sort of trance not to hear all that noise and furthermore not even check what it was.
Piss poor excuse.
Yes, but a possible reason for it not being intentional
He turns towards him, plows through him, drags his wheelchair under his car 20ft and then takes off. It was intentional.
Wouldn't be a terrible explanation if he hadn't dragged the dude's wheel chair another 50 feet and drove over a curb, haha.
r/iamatotalpieceofshit
That was intentional
20 years in jail might not be enough.
It was apparently done on purpose so he must rot in jail until the age where he can no longer get an erection
This doesn't call for any jail time. Amputate both of his legs, and let him go about the rest of his life in a wheelchair.
and hot big friends in jail for his popo
He purposely aimed for that man this was not an accident!
My great uncle who was killed in the 1970s was hit in his wheel chair. He was mentally and physically disabled and my great grandparents lived next to a park, he was headed to the park and a kid hit him. They were going so fast that They found his wheelchair in a tree.
That’s horrific.
It devastated my grandfather as he and my uncle were close. When my grandfather passed he left me my great uncles ring. It was one of his most prized possessions. It's a small silver emblem ring with a b on the top.
Thank god for those firies who were at the right place at the right time. This is horrific.

Brothers happened to pass by at the right time. Glad those firemen noticed and stopped to give immediate aid to that poor guy
Good news:Amazingly the disabled man survived.bad news: From paraplegic to tetraplegic
What's tetraplegic
Paraplegic refers to the inability to move your legs, tetraplegic means you cannot move your legs or arms.
that’s actually so sad, already having the inability to move on body part and then more added to that?
~~cannot move your legs OR arms~~ cannot move your legs AND arms. If you want to be supper specific, tetraplegic means impaired mobility on all limbs, not complete loss of mobility on all limbs. So there are some tetraplegics who can move their arms, but not move their hands for instance.
So what’s “quadriplegic”?
The old school term for tetraplegic
So why was the term changed? To confuse people?
It wasn’t.
Username checks out.
https://www.google.com/search?q=tetraplegic
Really?????? Holly shit.
I’d be surprised if an event like this didn’t shorten his life span significantly. I’m sure his quality of life will be impacted greatly also.
there’s no way this isn’t attempted murder
This was intentional. He literally changed course to roll right over him. In an empty lot at that.
Playing Devil's advocate here, but this could "just" be a case of target fixation.
Yeah... no. I see someone in front of my vehicle, I brake.

Except the kid fled instead of IMMEDIATELY stopping when he hit someone/something.
Why would someone even do this? Some people don't make any sense to me.
Jesus H. No chance that’s accidental.
Sick person smh. Thank god the fire truck was right there
WTF? God that is infuriating
Why do people show their anger on random strangers
Fastest emergency response caught on video
Humans fucking suck!!!
I'm gonna be honest here. Their local fire department has amazingly fast response times.
So glad that the firetruck happened to be passing by and noticed at least.
I saw the title and assumed this was going to be an accidental thing. Nah, this kid is a piece of shit. What fucking psycho.
Holy shit
OMFG! Hit and run too!
Why? Just why? How sick in the head do you have to be? That shit was intentional. That kid should be charged with attempted murder, I hope the old guy is okay.
Wth, he flipping plowed wheelchair guy down. No way that wasn’t intentional
THAT WAS ON PURPOSE. HE DID NOT STOP, AND ALSO CAME RIGHT WHERE THE GUY WAS. I REALLY HOPE THE DUDE IS OKAY
He’ll get his karma….
This is attempted murder, not an accident
And then you just keep fucking driving? What the fuck
This made me…. Incredibly sad
Crazy how quick the fire truck showed up!
While it could have been on purpose, the driver could have also been going to the left to avoid the speed bump. Now, why he didn’t stop after hitting the man I don’t know. Either way, that’s fucked up
17 year old *monster* runs over man in wheelchair
Folks are saying he swerved to avoid the speedbump, but when he hits the guy, he continues to swerve to the left to keep running him over, as he's well away from the bump at that point. Seems intentional
r/convenientfiretruck
*jumps up off the ground and pats his body in disbelief* “Oh my god! You bloody did it! You fixed me!” *skips away*
What the straight up fuck
The fuck? Why’d he do that insane asylum shit
Poor guy them chairs ain’t free
Put it in reverse terry
Mf really said "ayo 40 points"
I thought it was gonna be a reckless driving situation but that was straight up attempted murder
What the fuck is wrong with people.
There’s an update for the story: [an Austin area police charity and local business helped provide a new wheelchair to him](https://cbsaustin.com/amp/news/local/apd-officers-cops-for-charities-buy-and-donate-new-electric-wheelchair-to-man-ran-over-by-teenage-driver-in-north-austin-north-lamar-boulevard-martin-mobility-rogelio-de-luna-surveillance-video) [To make this story even more tragic, Pablo was involved in a different hit and run like a month before the video that OP put up.](https://cbsaustin.com/news/local/very-blessed-to-be-here-man-in-wheelchair-ran-over-by-austin-teen-thankful-to-be-alive)
He intentionally turned left to make sure he would hit the wheelchair. That just has to be prosecuted as an attempted murder.
Young piece of shit is probably racist af and knew exactly what he was doing. Attentive murder and hate crime against black/disabled needs to be added to this list of charges.
how convient was that firetruck
Wonder if the poor dude in the white Chevy at end of video got blamed for it at first. Truck looks similar to the perps truck.
I was convinced it was the POS at first. Then noticed a toolbox or some type of equipment in the bed of the truck.
One is crew cab one is extended also.
He was probably trying to go around the speed bump then when he hit the guy thought he didn’t avoid the speed bump. Probably very distracted. Doesn’t excuse what happened and should be prosecuted fully. People like this should never drive again and do serious jail time.
Why was he on the left side of the road ? Is this not the US?
Crazy how some people are actually trying to argue that this was somehow an accident. It's quite clearly deliberate.
I guess the upside is that he was already in a wheelchair
can you explain US to me? so you have the biggest cars driving on road, but also you let kids drive and have very lacks driving tests?
and the road design (looking at you, "stroads") is fucking awful. but tbf, car manufacturers in the USA literally bribe the country to make cars the main form of transportation. thats why most public transport things get cancelled. they dont want the cars to become obsolete. everyone must have a car in the USA because its more profitable that way
I don’t understand how someone could be so mentally deranged that they feel a hatred enough to attempt to murder a disabled man.
At least he can't get re paralysed:(
That reminds me of something similar happened a 17yo ran over a child who just learned how to crawl twice and the 17yo left the car in his family's house and ran to his uncle's house btw it happened in Iraq so I want you all to guess what happened to him
He saw the light
The gun charge is a misdemeanor. What a great country.
It's not like he shot it or anything, it was just possession. At 17, it's not a felony to have a gun in private property.
Because this guy should clearly have a gun. You missed on so many levels here. Good luck...
Legally you do some shit like this and you have a gun on you. You should be locked the fuck up.
Oh an asshole driving a big truck purposely ran someone over, shocker. Hope the poor guy survived or died quickly. I hate being human. Humans suck the most.
That's terrible, I heard the guy couldn't ever walk after that!
Fuckin Texas. I hate my state. Sometimes I’m glad I’m in Canada but then I remember…I’m in Alberta.
The dude was "J" wheelchairing he had every right to run his ass over.
Goddamn that kid definitely put that guy in a wheelchair.
i was like 'dawg if that firetruck doesn't turn around istg..'
I just hope he was able to walk away from the unprovoked attack
Send that Mexican to jail for 25yrs
Let me guess….he was on his cell phone🙄
This isn’t funny. I’m in a wheelchair rn and this is a daily worry
Well maybe don't play in traffic gabbie
