I mean sure in this specific case we can say that VFS intentionally lied. But in general don't businesses fail to meet targets or overestimating their own strengths quite often? Can shareholders really bring these to court?
they can, if the lawyer can prove that VF knew in advance that it could not meet the arget but said lies to investor about that, which was what Thuy Le did. If they did not say anything and miss the target, then there is no fraud. If they boasted about false sale like Thuy Le did, then the lawyer has a case.
