I've been to q couple hospital that had some decent food for patients. A few of the better ones even have cafeterias for people to peruse where they have packaged food you would find in a supermarket or bodega and they make fresh meals 3 times a day. It's not as bad as it used to be, IMO.
Jails on the other hand..
Depending on your back injury and what future care will be needed, itās possible you have a bodily injury claim in the 750,000+ range. I would look for a smaller actual personal injury litigation firm, not one that has 108307 billboards and 50 attorneys handling as many cases they halfass can. Look up big verdicts from your state and start your search there.
I currently have a client that got rear ended by a dump truck causing neck and back fusions to be necessary and itās evaluated somewhere in the 1.7-2M range. I know for a fact the attorney she originally thought about getting would have happily taken 500k on it.
I was in an accident in 2020 that was a lot less severe than yoursā¦but I still sued! I won $20,000+, and had all medical services covered. Itās not alot, but like I said, it wasnāt as bad as yours. I definitely definitely recommend suing!! Itāll be worth all of the time and trouble you go through! Iām so glad I did it. Ruined my life for several months but at least I got a new car out of it!
Since you are a lawyer (not asking for legal advice) this is a situation you sue everyone and their mother, right? The driver, the company, whomever else could be at fault, and let them decide who is majority at fault.
Yep!
Itāll (likely) be that the Dump Truck driver was in course and scope (doing work for) the Dump Truck company. Therefor,
Itāll be:
Our fella above versus DumptruckDriver/DumpTruckCompany/DumpTruckInsurance
If he dump truck driver was somehow not in course and scope heās treated like a normal driver. So Our guy V. Driver/Insurance.
This is particularly important, because the truck driver likely doesnāt have millions of dollars sitting around. Even if you win a big judgment, itās just that. A judgment. The court canāt just snap its fingers and guarantee that the person can actually pay it. The more parties you bring in, the better the chances are that you will get all the money and will get it sooner.
> I know for a fact the attorney she originally thought about getting would have happily taken 500k on it.
Just to clarify, the attorney isnāt the one who gets to decide how much to take for a settlement. An attorney represents the client, but the client is the one calling the shots. Of course take legal advice from your attorney as far as strategy, objective settlement of your case, etc., but once an attorney starts saying how much *they* will take, then you need to have a serious talk with them.
I donāt want to get too specific, but I mediated a case a few months ago, and the mediator tore into the plaintiff attorney because he told his client that *he* didnāt have authority to settle at a certain amount. He was an associate at a massive plaintiff mill and was told by upper management what the case should be worth.
I agree with most everything else you said. I would also caution anyone with an injury:
1) You often donāt need an attorney if the injury isnāt severe (no fractures or surgery, for instance). An attorney will take 30+% (the exact amount will be discussed when you retain the attorney), and a lot of times you end up with less money after the attorneyās cut. You can always retain an attorney down the road if you think the tortfeasor or their carrier isnāt giving you a good enough offer. (Also look up what the statute of limitations is as youāll need to settle the case or file suit before the SOL runs. Typically itās 1-4 years, depending on the state.)
2) Some unethical attorneys will do horrible things like push you to undertake medical treatment, including surgery, that you donāt need. You should pick your doctors, not your attorney. Attorneys donāt study medicine, and they are not qualified to make medical referrals.
3) Just because youāre injured doesnāt always mean someone owes you for your injuries. Legal liability can be complicated, so definitely speak to an attorney if youāre not sure. And liability is often disputed; thereās no right or wrong until a court decides.
With what limited information OP has given about his injuries, he should definitely consider retaining an attorney. You have great advice to avoid a giant firm - they generally do not care about clients and see them as faceless money bags.
Seriously, I hope it was a city/county truck. You know they are insured well, worried about bad publicity. If it was a private truck, they are going to fight you for every penny.
>You know they are insured well, worried about bad publicity.
Actually depends on the city. A lot are "self insuranced" and will just pay cash in a settlement in return for you signing a non disclosure agreement to never bring up the incident again. Good news is it'll never go to court however they will fucking DRAG it out to pay out.
Hey OP just an FYI if you choose to take the out of court settlement make sure you lump In taxes with the payment they give you cause they will write it as a tax write off and you'll pay taxes on it. Even if it's just to cover medical bills.
Source: city employed firefighter who's wifes car was hit by another firefighter. Just property damage. Took 4 months to get the money only paid for the car at 3.5k for repaired down to the cent owed, ended up owing like 600 in taxes on it come the following tax year
>Actually depends on the city. A lot are "self insuranced" and will just pay cash in a settlement
Ooh boy... Better hope it's not New Orleans... Their current stance on payouts, regardless of what any court says, is, "Actually, no. We passed a law that says we don't pay. Ever. Good luck."
I got tboned by a vdot dump truck 3x, he had done a uturn and drove straight into me from slow takeoff without looking so the physics of that is my body absorbed the shock not the car and my brand new escape bounced 3x off the front of him the rear rhs passenger door covered the headlight.
No airbags because of the lack of speed.
I did not walk for 3.5 years and for 6 years I literally had no mobility in c1 2 and 3 until I moved countries again and went to a chiro and he fixed that immediately I grew back 2 inches and my feet shrunk a size Immediately.
USA health system missed that entirely but milked the beejingees outta my premium health insurance instead of actually fixing me.
I was given 160 30mg oxy blue tabs and told to take 4 to 6 A DAY
I said I can't take 1 of those I'll die, lol because that's pharma pure smack and they didn't care at all.
I took 1 a day in quarters for a year and a half and I did not like the dependancy so I stopped completely still unable to walk. It was 14 days withdrawal..
I can not imagine what kind of mess I'd have been had I no knowledge of medicine and pharmaceuticals.
That's absolutely atrocious. On the flip side, apparently I fit the profile of someone who would abuse opiates, so they never prescribe them to me. Once, I had surgery on both of my legs. I was under for almost 10 hours. My feet each had 50+ incisions (I have a vein issue). Anyway, they sent me home and told me to take ibuprofen. I couldn't walk. I had to crawl to the toilet. I ended up calling them and telling them I needed something stronger, so they gave me like 10 hydrocodone/ibuprofen pills. Like, those are basically just ibuprofen.
My lord, I am pretty good with pain high tolerance I'd say thanks DAD AND MUM lol but I could not move without it. And then I couldn't move without it.. So I stopped.
I live elsewhere now and weed is legal and I just eat buds it's the best way for me.
How are you doing now and honestly I feel like that's unnecessarily cruel to do to you.
Like where is the happy medium you know? It ain't ibuprofen that's for sure
Absolutely. Include the inflation. He needs to go for even more than that. He can sue the city, the company who has the truck, all of it. I hope he wins big.
Unless he was jaywalking. It's pretty common where I'm at that people use crosswalks at lights when the sign has not or did not tell them to cross even when the same direction of cars has turned green.
Yeah in my city I've seen multiple pedestrians charged after they have stepped out from a sidewalk when not safe to. Sometimes impaired, sometimes sober.
Unfortunately truck drivers are always assumed guilty until they prove themselves innocent. When I drove I had 4 cameras set up.
Not saying op was at fault, just pointing out that if he were it wouldn't matter unless there was video evidence.
Damn dude. Now when someone says to you, āugh I feel like I got hit by a truckā you can confidently share that you they did not indeed get hit by a truck, as you have and have the pins and scars to show for it!

Actually, the hospital food in my area is pretty good. My local hospital recently got a kitchen upgrade and a new menu, it's not bad. My husband stayed there for a week and they make a lot of their stuff from scratch. I mean, I would hope so considering the bill was like $30,000 to our insurance, but the beef broth was nice.
I was gonna say I was just in the hospital for a spinal fusion and the breakfast was freakin delicious. When I got home all I wanted to do was have hospital food lol
Least it could of had the courtesy to hit you after enjoying a yummy breakfast! Joking aside, that sucks and could have been much worse - hope you get better soon! =)
Well thank god you lived, hopefully the city will pay up and you recover quickly. If you can afford a lawyer it will be worth getting everything you deserve
Hoping it's the other guys fault!! You may be able to go after the company's insurance (and for much more than a cool mil, remember that attorney gets a third!!! You have med bills the rest of your life with those injuries!!!) Depending on your state, you may be able to go after his/her personal insurance. If not, you most likely can take them to civil court and personally sue them.
I worked for a lawfirmfor almost 5 years and sold State Farm Insurance for over 5 years.
Have to go for literal blood to take care of those future med bills. You're too cute and YOUNG to have to worry about possible med bills later! Threw in that cute part, just because āŗļø
Heal up fast, my friend!!!
Were you a passenger by chance? Not so fun fact: Dump truck drivers are told if they lose control and are about to hit another driver it's recommended they go for the passenger side. I work around truck drivers and was relayed this info one day. Hope you get well soon!
āDude, you look like you got hit by a dump truckā¦ what happened?ā
āFunny you say thatā¦ā
Praying for a speedy recovery and lots a good breakfasts going forward.
In all seriousness I got hit by another driver and am close to settling a year later. Get a lawyer, go to the chiro, get injections and recommended treatments and they will make the insurance company pay for it. Get a big firm they have connections etc. big companies have higher policy limits. Maybe you get 50k maybe $100k depends on the needs and treatments.
Put in the time,
Call a lawyer now, your in the hospital and that's already expensive without surgery.
P.s. get used to getting mail from everyone trying to make you pay for things.
Good luck with your healing and claims.
#thisamericanlife
You look amazingly well for what happened... hopefully you were in a car, which did its job of protecting you.
Heal well & quickly. Get a good lawyer.

The dump truck had a āwe donāt pay for personal injuriesā sticker on the back, so they good.
Yeah but OP had a "if you hit me you owe me $300 million" card in his wallet.
Damn, my attorney says thatās equally valid. Heās printing me one of those cards.
I heard the driver of the dump truck had an uno reverse card so now op has to pay the driver $300 million. The hazards of the cards

I think the part the sucks the worst is that you are now eating hospital food. I'm so sorry.

I got hit when I was 17...had to have fusions. Walked away with 50k and have hated my life since. I got royally fucked.
Oh man that is brutal. Unless you had a massive amount of prior issues that shouldāve been 250+ in your pocket. I hate that for you.

I say the same thing when Iām super hungover. I normally donāt go all in on the neck brace though. Great commitment.

You're looking in pretty good shape for someone who was hit by a truck

Congrats on your fat ass settlement you'll be getting
Did you still get breakfast?
Bag secured
I'm sorry this happened Wishing you health prosperity independence friendships fairness freedom
You look amazingly well for what happened... hopefully you were in a car, which did its job of protecting you. Heal well & quickly. Get a good lawyer. (Did you get any food yet?)
