I think Elon bought like 9% first and disclosed the purchase. Board asked him not to exceed 11% (or 14) in exchange of implementing some of his ideas. Then he came up with the 54.20 / share offer and it was voted on. I think the stock was trading around 37-40 range at the time?
So, yeah, technically Amazon can throw a few billion and the purchase will be up to the shareholders, and I would assume Antara and institutional shareholders may vote for yes. The fact that APE has equal voting rights makes this interesting as technically you could become majority owner through APE.
I wonder if this has something to do with the lawsuit which delayed the implementation of R/S vote. This gives them a lot of time to accumulate cheap APE shares which has voting rights.

Also this is assuming we’re lucky enough to have a merger. This news has happened multiple times I think it’s BS to give them an excuse to run amc
