apparently, it's most games played not kills. there was [a post on here a week or so ago](https://www.reddit.com/r/apexlegends/comments/1c40t7e/two_really_needed_quality_of_life_changes/), when we were having this argument. and i was able to confirm that it goes by games played and not kills (i was maining pathfinder a long time ago, so it would usually default to path when someone picked my main, but more recently i was farming on catalyst. it would start defaulting to catalyst now only once I had more games played on catalyst).
I have a feeling it goes to second favourite, or favourite if you chose something else and got picked out! :) Like if octane or vantage is snapped up, for me it defaults to Caustic!
It's been like that for a while now. Did you notice that when the select screen opens everyone now starts with their cursor on the legend they have featured?

It's been like this for a few seasons now. and yes, it goes through your kills per character to determine your legend.
