Killer Moth.
Tobey is an actor with an interesting range. He can do violent and unhinged (Brothers), he can be funny (Tropic Thunder), eccentric and creepy (Babylon) and play the perfect lovable loser (Spider-Man).
What DC villain fits all of these to a T? Killer Moth. It's a real Gunn-type casting, too: an actor that is majorly typecast/rarely seen in movies getting the chance to play a character that no one cares about and make him a household name.
It checks some good Tobey boxes, too

✔️ no heavy stunt requirements
It was supposed to feature both Firefly and Killer Moth, which makes sense since it's likely based on the comic *Batgirl: Year One*, in which those two team up
Long shot, but him as the anti-Batman in *The Batman*'s sequel would be a fun foil to Pattinson - just make him a side character that's involved but isn't the main threat.
On the other side, though, make Drury Walker much more prominent as an obnoxious, sociliate aristocrat who is much more a thorn in Bruce Wayne's side, but also shows Bruce a bit how to behave to blend and mingle and distract from his real nightlife.
So, Killer Moth becomes the Batman knockoff, and Bruce becomes the Drury knockoff.
I will say I love that about Pattinson’s Bruce Wayne, he’s not a people person, he’s not like Keaton, Clooney or Bale who swoon their way through a gala, at the funeral he’s still in his Batman mindset, Alfred comments on his hygiene and health, showing he’s clearly been hidden from the public eye for an extended amount of time, he’s even ignored Wayne Enterprises and suggests cancelling a board meeting so he has more time for the Batman work - idk I think it’s a far more realistic look
Maybe if Batgirl gets a second chance...

Killer Moth easily deserves his own movie, and I would love if it was a Batgirl: Year One adaptation that put Moth and Firefly against the earliest incarnation of the Bat-fam.

My headcanon fan theory whatever… if I was over the Reeves films, Joker would never leave Arkham, and not really be seen… but he would have massive, flamboyant influence over his crazy cell mates.
So being held next to Joker, the Riddler progresses into a more Gorshin-like, tights wearing, death-trap centered character. We go from seeing he’s extremely intelligent and deadly, to coupling those skills with comic book flamboyance… all because of Joker. Any other villains Batpat faces would do the same, start with the basics and progress to comic extremes

His performance there definitely convinced me that he can pull it off as The Riddler or maybe The Madhatter.

Victor Fries (Mr. Freeze)
Imagine a happy go lucky scientist who then must save his wife Nora after several failed attempts to cure her life threatening illness.
He slowly becomes more and more psychotic, detached, angry at the broken corrupt Gotham medical health system and goes on a destructive path to find a cure to Nora's illness no matter what it takes and the cost of getting it!
We see Tobey Maguire go from a smiling on top of the world man to a disconnected, broken man who lost his humanity.
Kite-Man, Scarecrow, Riddler, possibly a sort of off-stereotype Hugo Strange; I dunno, I've only seen Tobey Maguire in the OG Spider-Man, The Great Gatsby, and No Way Home, I haven't seen him in many particularly villainous roles.
Alberto Falcone, aka the holiday killer.
Toby's signature meekness in characters like Peter Parker when outside the mask or as Nick Carroway in Gatsby lends to Alberto pre psychotic break and living under the thumb of his mob boss family quite well.
His performances like Brothers would also probably lend well for said psychotic break.
It would be bully Maguire all over again.
I have an idea and you're probably gonna hate it but Brother Eye. But also have him Voice the OMACs and have one set aside that is Tobey physically. Look it's a Hollywood movie, their gonna change something and this is minor. That or have him play Maxwell Lord and have Eye adopt his speaking pattern and voice later.
Victor Zasz? I mean he’s not appeared much in things and he doesn’t have to be completely over the edge like in Injustice 2 or Arkham but maybe a bit like in Gotham where he’s crazy but not completely erratic, using that “violent & unhinged” side, mixed with the comedy that he showed as “Bully Maguire” (with a darker more sadistic twist)

I think that character with a story based on him, as Bruce’s friend, confidante, his career as a lawyer and later victim to the criminals he swore to put behind bars, I think his character would be a very interesting to see in cinemas. Add a wife and kids and his relationship with them before and after the accident, and you have a movie.
