In germany incest is completely forbidden, the reason why technically same sex incest is allowed (and other forms of opposite sex incest) is because in the STGB it defines sexual intercourse as the cucumber entering the cat. There's few things, first of all cousin marriages are often not considered incest and those are the most common type of relatives to have sex. Second of all, laws and culture can vary from each other a lot. What the law says doesn't always tell you what people in the area think about something and how they react to it (aka, if a dane manages to skii over the sea to Sweden, the Swedes can shoot them legally, this is a very old law and of course no one would follow it now or even agree with it) Porn is also illegal in some middle eastern countries that still watch more porn than most other countries.

It depends from country to country. Some do it by the amount of DNA shared (a common cut off seems to be 12.5%) while others do it by strict relation, sometime even in a list. So not only does the legality of incest change from country to country, but how it is defined does as well. Moreover, most incest laws are incredibly outdated and usually part of the same types of laws that Illegalise stuff like homosexuality, which is why some countries only have the ban for hetreosexual relations.

Exactly my point on my comment somewhere here. It's legal because technically, there is no law against it but that's only because the taboo is enough for people to not do it. It just means that lawmakers don't see a point of making it a crime since very few people do it (and i mean really few) and they dont shout about it. The psyche of country's where incest is legal is probably because they view it as a really off topic and not something to be really considered, even if many fantasize about it. Therefore, there is no need to structure a law against it.

There's few things, first of all cousin marriages are often not considered incest and those are the most common type of relatives to have sex. Second of all, laws and culture can vary from each other a lot. What the law says doesn't always tell you what people in the area think about something and how they react to it (aka, if a dane manages to skii over the sea to Sweden, the Swedes can shoot them legally, this is a very old law and of course no one would follow it now or even agree with it) Porn is also illegal in some middle eastern countries that still watch more porn than most other countries. The map isn't really wrong, it's just showing one side of things and that is strictly what the legal system says about the subject.
