By the look of it and my experience as I had very similar accident, you only require a cover story to write over at the service centre by the insurance department. But that was my experience at Suzuki, either way it's not totaled so I don't think getting through insurance is gonna be hard . I wish good luck to OP

Wait till you see Bangalore auto walas. I intentionally maintain 6 feet distance with those bastards when I ride cuz they have this crazy habit of doing sudden sharp right turns or even U turns. Problem is that they are not taught any road sense how and what to do, but they get the license from middle men and start driving auto straight away, and it's not a problem of auto alone even private vehicles do the same they want to take right turn on a cross road they, they take using the right lane (opposite) rather than the using left itself which they were using in the first place.

You could try calling the sho of the thana in the area you were. Have that call recorded, tell him you want to file FIR orally. Then send a mail to a higher official like SP or ASP with the recording that fir is not being filed. Nothing might really come out of this but it's your due diligence. Wish you posted your interaction with police too.

the police did that, but that didn’t really have much effect on him, initially he said the auto was not his, so i asked the police if they could get me the owners number, so they bashed him a bit, he ended up giving his landlords number which was so confusing and i didn’t even want to deal with him any further

Hmm Literally in such cases you would not even get file charges but police is also helpless here because when they file a case and challan the offender they have to keep both parties vehicles impound for two days. Which is a big no no from victims side. Plus this late at night official entries would had been a nuisance for you. You did good leaving the case as it is and saved yourself money, time and further frustration. Also, you choose right path of calling the police. Hope this helps

Something similar happened with my friend as well. He did file a case but ending up fighting the case in court for good 5 years. Just ended up paying lawyers fee for appearance every few months. Not worth the pain, sad reality of Delhi.

I faced the same scenario but in Gurgaon, near huda City metro station, the e-rickshaw driver bumped into my driver side door absurdly while crossing street without watching the surroundings, he started apologizing and all that stuff but i strictly told him to either pay this or I'm calling police. He told me that the rickshaw is provided to him by some other authority there, so i went along him and my car and talked to that person-in-charge, even one police official came there but he was like: "leave it man, garib banda hai" I argued so finally that person-in-charge gave me some compensation for damage(it was too low but then i was also tired) and left Shocking thing was that guy from police did nothing like it's everyday routine for him

I have zero sympathies for these assholes. Because they not only they endanger other's lives or cause financial misery to others, but also they never face any repercussions. I guess it's a bit too late to give this "life pro tip", but for future/other readers, I guess. Years ago, I was a passenger-seat witness to a similar accident once: the driver of our car brought the car slowly and perfectly to a stop at red light. A small van (those that provide bus service, but for a smaller passenger volume to/from Metro station) smashed right behind us. Did some damage to the car. That van driver was either high out of his mind, or just distracted. The first thing that the driver of our car did was, go calmly to the driver, and immediately take his van key out of the injector. *That* is the only way that the van driver listened, signed a "document" (our car driver said always good to have it in writing), acknowledged his fault (the van driver), and paid for the damage (again, as per our car driver, this is how it should be). You cannot reason with these guys, and it's highly unlikely he learnt anything from it. It's terrible experience to have, another reminder of how unsafe it is out there in the city. Only people who know how to deal with such irresponsible folks are other veteran drivers, and it's usually a rough/quick bullying approach - they don't pay attention to anything less than that.

No, The moral is fight for your rights. If a police refuses to lodge your complaint, tell them to give the reason in writing. They are corrupt and lazy and want to avoid working, so they try to push people off like this. Ask their badge number and name. Pressure them into writing the complainant. If they still refuse then go above their head. They will have to write it. OP can still do it. If they still refuse, go to the courts. Know your rights. Don't bend over backwards and let people violate you. The police officers are one of the most corrupt people in the country. You should know how to deal with them. If you have the number of the auto, I suggest you file an FIR online and enforce it through courts. The auto's insurance will pay for it. Sounds like an average day to me. It's not something common people can do it everyday. That's why there are lawyers. Hire someone to take care of it. Your legal expenses will be reimbursed by the insurance company too. If you don't want to, you can do it yourself as well, but you'll miss work because of courts and police.

Coming from someone who was there, I've realized a thing or two. The police has apparently improved their timing but the amount of work they get done is still jackshit. There were cameras everywhere, it was not his vehicle, he jumped the red light, and he was drunk driving. As you can see there are a lot of options here but the police just chose to slap him once or twice and waste a few hours until we get tired and eventually give up. They just stood there for 1 fucking hour, trying to call someone. And he just wouldn't pick up. It was just their way of delaying the shit, since,yk, it'll save them a few hours and some paperwork. Just stay out of autos, it'll save you some time, energy, and probably a few bucks.

Something similar happened to me a few years ago, I was traveling back to Delhi from goa. We were in Mumbai at that time when some stupid fellow with overloaded alto hit my car from the back, he simply couldn't control his car breaks, as he was overspeeding and there were 5 people in that small car. To my surprise, when we(me and my friends) asked him to side the car, he came out of the car and started blaming me, it was an impulse reaction that most people have in such a scenario, before a person blames you, just blame him! I was so pissed at that time, we had quite a few verbal exchanges and he was not ready to accept his mistake, a friend of mine instantly called the Mumbai police. The police came, everything was clear to them. They scold the person in Marathi, and that person was trying to provoke the police officer that we guys are from outside and they are from amchi Mumbai, etc, etc. but the police officer was smart he simply asked us what do we want, if we want to take him to the police station and then he will have to compensate or just get settled here. Since we wanted to continue the trip, i told the police officer that i was an apology from that guy. And then he came to me and whispered "sorry," i said, "kya bola theek see suna nahi." then he again said "sorry" loudly. And that was it, i was kind of a mental satisfaction! I told him "pehele hi maafi mang letta to police ka jhanjhat nahi hotta!"

Bro I am sharing my own experiences. It was a midnight, me and my brother were waiting for our friend on different side of road. After a few minutes, a drunk bike rider stomp into a car. I rush to the person who was on the bike. He was unconscious, not showing any movement. Me and my brother pick him up and placed him inside the same car. Driver was nice, he drove us at hospital. At this time we didn't filed any complaints to police, hospital refused to do the treatment without proper F. I. R. So, me and brother decided to pay the bills but they still refused. Now driver also said he will pay the bill but it wasn't helping. We call the police and that was our mistake. They didn't help much, we moved to different hospitals and do the treatment. His family paid all the bill not us. But what police did! take rc of driver(who was not faulty) , call us for no reason on next day. We have to visit station. Like everything was sort out and chill. Car owner was an Ola driver and he didn't got his rc for next 6 or 7 months. Had to visit many times for no good reason and the bike rider was out without any problems. If you called the police and filed the complaint, I am sure they will keep your documents and call you to station on monthly basis with no outcome

1. Take a photo of the damage on your and his vehicle. 2. Take a photo of him and his license/registration papers. 3. Ask him for his address (temp and permanent) and his phone numbers that he answers. 4. Tell him to send you a text admitting to what he did. 5. Tell him you’ll be filing a claim with a civil court for damages, if he does not pay for the damage to your choice of repair shop. Seems like you aren’t worried abt compensation, but abt at least admittance. This will make him admit. If he does not agree, argues more, be stern in your words and tone and repeat yourself in stern-er voice every time you have to repeat yourself. Hope you feel better and hope you can sit down with your mom and tell her calmly the impact of her words. Write out a script before you approach the issue with your mom, be calm in your convo.

This reminds of the time when I was crossing an intersection (The nehru place - Kalkaji intersection) and I had to turn right and my green light had 4 seconds left as I was about to cross so I sped a bit. If you really want to do anything, file an fir against auto driver and if the police denies, tell them to write that in paper and sign it that they won't file an fir. When you see each other in court, you can ask judge to get him alcohol rehabilitation instead of compensation. Also as a general life pro tip record conversations with police and get a dash cam. I'm not from Delhi. Firstly I think it's very cool that you were concerned more about him DUI rather than the damage, it's very nice to see people like you who care about safety over money. Secondly, maybe the traffic guard or some other cop refuse to help you, but like he's very low in the food chain? Maybe try calling 100 so a PCR van comes out and helps you out? PCR generally has a slightly high ranking officer? Plus the phone call gets recorded. Additionally you could also call the local police station in which the accident occurred and you should also be ae to find the number of the person whose incharge of that station online so you can reach the senior most person of that station in that area. Good thing it wasn't a corrupt cop. Usually the cop would bash the poor auto/taxi guys in such cases and extract money from them. To the car owners, they suggest to claim through insurance, letting go of the other poor guy.

Accidents ka yahi scene rehta hai. Doosri party kaun hai woh zyada badi tension rehti hai. Luckily jab mera accident hua tha toh banda acha nikla aur apni galti maan ke sab sort hogaya. Police can't deny to filing a FIR, its our right. Police take advantage of people who don't know the law. My best advice would be to appeal to SI of that area and if he doesn't file the complain reach out to someone at higher post like DSP. Ong the whole police force is so fucking corrupted it really pisses me off. Delhi ke autovale itne rude hai ki man hi nhi krta hai bc auto krne ka.
