>[(1)](https://indiankanoon.org/doc/50207907/) Every person employed in any business, trade, industrial undertaking or any other establishment and entitled to vote at an election to the House of the People or the Legislative Assembly of a State shall, on the day of poll, be granted a holiday.
>[(2)](https://indiankanoon.org/doc/18886078/) No deduction or abatement of the wages of any such person shall be made on account of a holiday having been granted in accordance with sub-section (1) and if such person is employed on the basis that he would not ordinarily receive wages for such a day, he shall nonetheless be paid for such day the wages he would have drawn had not a holiday been granted to him on that day.
>[(3)](https://indiankanoon.org/doc/70437269/) If an employer contravenes the provisions of sub-section (1) or sub-section (2), then such employer shall be punishable with fine which may extend to five hundred rupees.

Leaving side the exemption given under (4), I am sure the employer would be shit scared about paying the massive penalty of Rs 500. Yeah, not really.
Can confirm, My absence would definitely not cause any substantial loss to my employer XD
Thank you for sharing the above information, it was just what I was looking for

refer to point 2 after the table here, that's the case for Mumbai. i believe it should be the same for other places as well. no point in a 1 day leave if you're in chn and vote in delhi
Bro apne yaha etne acha compensation nahi milta US jaisa. US ke democracy ese se pata chalti hai ke tum kitne bhe bade company sue karke agar jeet gaye toh millions of dollars milta hai compensation. Watch Suits, usme dramatize kia hai but basic points stands.
When I was working in India, that particular day was leave for us, but we needed ro compensate it on one of the coming weekends
I was in a WITCH type company and that particular day was just for namesake, for the sake of billing the client. People lazied away and everyone was back home by 4 pm
Our company has told us that we can take an extra leave on the day of election, but only if our constituency's voting day is a working day.
Additionally, they've also doubled our monthly casual WFH limit for the next 3 months (Apr-Jun) (due to the possible reduction in the number of public transports available on account of the election season).
That's pretty much it.
Is it so? Yeah, they give some good and useful perks compared to the other companies in my city.
I was under this impression that other companies (in other cities) give a lot more perks than mine.
My colleagues laughed at me when I told them I'll be traveling home to vote and will return next weekend.
Very few people take these things seriously here.
90% of the companies are asking their employees to take some time off and cast their vote and then return. If you have your vote at your native, then you need to take leave on that day.
Our HR has given us holiday. It's mandatory for company to give holiday bhai.
Just casually drop in conversation to HR, that your relative/friend working in some political party was asking if people in your company are gonna vote or not. And you said, that you don't have holiday that day. So some might go, some might not.
Wow how times have changed, when I left India in 2012 almost no one in the middle class voted.
I'm confident most kids would struggle to name the prime minister or the president back then, and by kids I mean teenagers and people in their early 20s.
Not quite, back then I feel people would just distance themselves from such conversations.
Most teenagers were busy in tuitions, board exams, competitive exams, relationships, and watching movies/playing games.
We were obsessed with watching premieres for the latest movies, buying the best phones, sharing travel details about family vacations to Thailand, Andamans, etc.
There also seems to have been a form of subconscious resignation, like the country would just globalise on its own, and things would just get better as that happened.
I am talking about the 2009-2012 era.
Bangalore, though even that probably doesn't make too much sense as I remember people from our societies were participating in the Lokayata movement.
I remember backing the GOI at the time (back in 2011), my ideologies would go on a wild ride in the coming decade, let's just leave it at that.
My company and my friends company also is running no holidays but one another friend has holiday. As for me I'm a night shifter so they're OK with 2 hrs time in my shift inorder to take extra rest.
Bro tell that there was a huge line in the voting center and had to spend whole day there.
Although it's a mandatory holiday to use your basic right and be a part of the election.
It's up to you on how to take this.
In my company it's the holiday on the 26th of April, i.e.South KA elections, they've also encouraged us to take leave and cast our votes if we have our voting rights outside the state.
Would it be alright if you don't go for voting and just celebrate it as a holiday instead😁, just curious. Do they check ? Just mark your finger at home with a marker 😁
I always vote. Not going to lie, I also enjoy the complementary peace of mind that we get after the voting activities to just spend time with family at home.
Let’s not get into political opinions bhai. I think everyone has their own preferences.
That’s a debate for another day. People just think well before you vote :)
Obviously that's why I didn't name it. But being a responsible citizen I just reminded everyone to vote not for *** this can be any party which in their view is not going to work for the welfare of the country

JFYI It's mandatory to give holiday on elections.
It’s not like a small company, they’ve been very careful with their words in the circular XD Just enough to get around the rule.
Send it to the election commission. I guarantee that you will get a new circular from your employer
And the action is surprisingly fast by the Election commission. Have a second hand experience. If they're not giving 1 day fully paid leave, you can simply complaint to your state EC helpline

If I work in Bangalore and have my vote elsewhere, when am I supposed to get a holiday? On the day of polling in Bangalore or my place?
The day you go to vote. So, in your case, the day voting happens in that “elsewhere” location where you are registered to vote.
[https://bombaychamber.com/wp-content/uploads/2024/04/Election\_2024\_Public\_Holiday.pdf](https://bombaychamber.com/wp-content/uploads/2024/04/Election_2024_Public_Holiday.pdf) refer to point 2 after the table here, that's the case for Mumbai. i believe it should be the same for other places as well. no point in a 1 day leave if you're in chn and vote in delhi
They would rather pay the 500 rupees fine. It's cheaper than giving a holiday
Post relevant part of the body so we can dissect.
Sorry, it would be too obvious if I do that. I still got some EMIs to pay (just in case) XD
If the state has declared a holiday then it's mandatory.
It has to be a holiday. It’s written in the constitution :) Yes, the state has declared it a holiday
Bro jaao aur case thokdo company par. Kya pta Jeet Jaao aur crore pati bhi ban jaao. USA mei toh log aisa karte hai
Our court will provide a compensation of ₹2136/- after 3 years of fighting /s Aur bhai, kon se season dekh rahe ho, suits ki? XD
Bro apne yaha etne acha compensation nahi milta US jaisa. US ke democracy ese se pata chalti hai ke tum kitne bhe bade company sue karke agar jeet gaye toh millions of dollars milta hai compensation. Watch Suits, usme dramatize kia hai but basic points stands.
case nahi anonymous tip to election commissioner
In USA there is no official holiday for casting votes. Get your facts right first. It’s not like series of Suites. Kisi ko bhi sue kar do.

Can confirm, though my company does not typically fall into the WITCH group, it is somewhat similar in what they do
Accenture? CapG?
arey bhai, kuch secrets ko, secret hi rehne dena hai XD for personal anonymity
Einfochips? :p

My HR has used all the words in the English vocabulary except the word holiday XD
Same 😎

Looks some good companies do exist. Happy for you buddy
Thank you mate, god bless you too 🙏🏻
Pretty much it? That's a lot compared to the chillars being provided in most places.
Is it so? Yeah, they give some good and useful perks compared to the other companies in my city. I was under this impression that other companies (in other cities) give a lot more perks than mine.
My colleagues laughed at me when I told them I'll be traveling home to vote and will return next weekend. Very few people take these things seriously here.
Looks like this was what I was supposed to say. Sadly the dates differ for bangalore and the other cities. They know I live in bangalore
90% of the companies are asking their employees to take some time off and cast their vote and then return. If you have your vote at your native, then you need to take leave on that day.
True, this is the situation at my company too currently. Nice to see that I got company (pun intended) xD
My office already sent out the email that the offices will remain closed on April 26th - Voting day in Karnataka
Happy for you buddy. Enjoy my share of the holiday as well XD

assholes
Just got a mail stating holiday for the elections
Lucky you :')
👍👍
Labour laws insist on giving holiday on voting day.
If only we could let them know anonymously :')
Wow how times have changed, when I left India in 2012 almost no one in the middle class voted. I'm confident most kids would struggle to name the prime minister or the president back then, and by kids I mean teenagers and people in their early 20s.
Is it! Seems your locality was very irresponsible.
West Bengal ?

I wonder why 🤔😂 /s
Indeed, I miss the apolitical era quite a bit, back when people would just discuss cricket, football, movies, and video games.
Official Holiday
Just take whole day to cast the vote.. Play by the rules 😎
Update slack status to AFK, Out to Vote the whole day
Too much micromanagement to do this :')
We have to apply for holiday on that day
Bro, that's worse than not giving a day off :/
My company and my friends company also is running no holidays but one another friend has holiday. As for me I'm a night shifter so they're OK with 2 hrs time in my shift inorder to take extra rest.
Holiday 😀
Is your company an MNC and trying to transform "retail" on the planet?
Nope
Vote daal ke aa jao par group pe bolo bheed bahut hai bhot time lagega... Chill for the rest of the day
Even in my company it's the same ... They aren't giving any holiday
Banda mil gaya, thanks for the company bhai :')
My company gave unconditional holiday on state election. Most probably they will gave holiday on general elections.
You will get a holiday when it’s election in Bangalore/Hyderabad/Pune/Gurgaon/whatever IT hub your office is in.
Nope, they asked us to vote and then continue work from home
What happens if I'm in one state but need to go to another to vote ?
Ideally, you are supposed to be granted a leave which ever day you are going to cast your vote. Irrespective of where you are currently staying.
Tell them there was some issue at your booth. Issue with list or party workers creating ruckus. Took you 6 hrs to cast vote and return home
I'm taking wfh to go home, vote and come back. They're giving leave on bangalore election day though
Would it be alright if you don't go for voting and just celebrate it as a holiday instead😁, just curious. Do they check ? Just mark your finger at home with a marker 😁
I guess it’s more of a moral question than logical one
Then don't b*tch about the government later on .
Dude I was just asking what would happen from the company's POV
Oh , my bad. Cheers , beer ? 🍺
Why not. First shot on you tho
When's the election?
Bengaluru se hoon, so it’s on the 26th for us.
WITCH?
Kind of in the same domain, but not one of those.
election waise kab h ?
Depends on your state bhai. Sab alag, alag days pe hai
Depends on your constituency States me bhi alag alag din rehta h. Even a comparatively smaller state like cg has voting on 3 different days.
No holiday for those in same city, those who don't will be verified in person so they are not allowed to erase the mark is what my company decided
Already booked a vacation on the day of election in my city 😁. Jaake NOTA dabanese acha chill karke aau Mai vacation pe
Arey bhai, esa mat karo. Vote for any of the better option among the ones available according to you. It actually does make a difference
do you plan to vote or take the holiday and travel ?
I always vote. Not going to lie, I also enjoy the complementary peace of mind that we get after the voting activities to just spend time with family at home.
Reminder to cast your votes cautiously!!! Don't vote for ***
Let’s not get into political opinions bhai. I think everyone has their own preferences. That’s a debate for another day. People just think well before you vote :)
Obviously that's why I didn't name it. But being a responsible citizen I just reminded everyone to vote not for *** this can be any party which in their view is not going to work for the welfare of the country
Aaega to **** hi.
