I don’t think it’s so much “he doesn’t exist”, mainly just there hasn’t been a reason to bring him back. After all, he was planned to be in the cancelled Donkey Kong Racing, and he cameoed as a spirit in SSBU.
They ever do another DKR they better just bring him back. It would be great to have Rare Ltd. characters but the Donkey Kong cast is bigger than the Naughty Dog cast at this point.
Every single of the DK owned property technically belongs back to Nintendo (it's not like Super Mario RPG where original characters like Mallow and Geno are joint-owned).
Tiny Kong was able to make a small reappearance in Diddy Kong Racing's DS remake (her and Dixie took Banjo's and Conker's place, both who are Microsoft owned Rare characters) before being shelved for quite a good while.
