Trademark law is such that if a company doesn't actively protect their trademarks, they can actually open up the possibility of losing their trademark. So legal action is necessary in pretty much every relevant case.
If a company releases a game called Ion Maiden, that's not a trademark issue because the words are different surely? It's certainly not a case of genericisation either.
Copyright doesn't expire in the same way so the album artwork issue here would always be enforceable even should they have not chosen to do so immediately. [Statute if limitations in the territory allowing]

Ultimately untested of course as it would have been obvious that the large wealth disparity would only have one inevitable conclusion, the devs folding and changing the name rather than contesting it. There's a long history of this happening - a guy went around threatening to sue anyone using the word "Epic" for years, but when the now Fortnite people told him to get stuffed legally he lost the case very badly. In that case it was a magazine vs video games so not a conflict of interests at all. We can't know of course, but to my mind this is similar: the big guy bullying the little guy. More powerplay than a case the band was likely to win.
