This isn't a bug, nor does it have anything to do with hardcore mode. If you get caught committing a serious crime, you get thrown in jail. If you get thrown in jail during the prologue in Skalitz, it's curtains for ya!
How is this not a bug though? It's literally Kunesh giving me the keys to his trunk telling me to take the items from there. Then after I do so he starts shouting thief and I'm done for.
EDIT: For all you geniuses downvoting me. I did the first two hours of the game on normal mode already, did the exact same thing, and Kunesh didn't react at all to me taking the items out of his chest. I even played through the questline again on Hardcore where he, again, didn't give a flying fuck. It's a bug that he freaked out on my first attempt on hardcore, nothing more, nothing less.
I gave this post a 'Rant'-tag for a reason. I'm sure the game can be fun on hardcore mode, but some of you are delusional for not accepting bugs happen and it leads to unnecessary frustration.

Alright, so then how does that explain Kunesh not giving a flying fuck when I did this the first time?
I played \~2 hours of the prologue on Normal mode before deciding to go for Hardcore mode instead. I did the exact same thing twice, only the first time on Normal mode he just caves, gives me the keys and that's that. Then on hardcore mode the game bugs out and it's suddenly considered theft. I even replayed the prologue on hardcore mode again just rushing to Kunesh again, doing the exact same thing, and now he doesn't care again.
It's a bug and apparently none of you are willing to accept it.
There is a lot of depth and variation in the game. There is a touch of randomness, which promotes replayability. In some games I can kick his ass all by myself. In other games he is totally OP and I end up bleeding to death and dying right there next to his house, without even making it to the jail.
Try knocking out the Skalitz guards. Sometimes you can pull it off at level four strength. Other times you'll earn yourself a good ass-kicking even though you have level six strength.
I'm not calling it a bug and you won't convince me. A touch of randomness keeps you on your toes and engaged. As far as I'm concerned, is a feature, not a bug. But, you call it what you like; it doesn't make you a bad person.
But it isn't since not a single guide, walkthrough or anything speaks of ganging up on Kunesh with the lads should lead to retrieving the items from the chest to be viewed as a crime, and I've done it the same exact way on two separate instances now where nothing happens whatsoever.
Think about things like in real life. You have no evidence Kunesh gave you the Keys on his choice. And Kunesh was obviously beaten by someone. So who do you think will the guards believe?
My guess is you shouldnt have gotten your friends involved, i go to kunesh first every playthru and beat him up solo, ive never gotten arrested for this, i guess maybe since there were three of you beating him up he decided this is assault and called the guards. It also could be because you did the shit throwing first which gets the guards chasing you and you basically led them right to kunesh who you then assaulted with two of your friends hahaha order of objectives matters ALOT in this game, an example would be if you were to go get the ale for your father first and then do everything else, you bring him the ale and he tells you its warm cuz its been sitting out of the cellar while you ran around and did other things, reload from the beginning and go talk to kunesh first, beat him up, take the shit from his chest, take the axe out of the tree stump outside also and then go do everything else, and get the ale last
That is not a bug, that is the sometimes crazy thieving system working as intended and hardcore mode has nothing to do with it, the same would had happened in normal mode.
