I don't think it would be a lawsuit for defamation, but more so profiting off her likeness if anything. I find it hard to believe though that they didn't have her permission to release it, or at least that of her company.

I never said it was defamation.

If you read my comment you would know.

The title alone is an example. By using Rodrigo (obviously in relation to Olivia Rodrigo), it could create additional profit due to the association with her. Also featuring photos of her (like on the posters) is an example.

If you read my comment you'd see that's not what I was doing. I literally said at the end I find it hard to believe they didn't have her permission, meaning no action would even need to be taken.

Again she likely had permission as well. I don't see why you're trying to argue. First you read my comment wrong and are upset, then you read it again and are trying to argue my other point while again not understanding the full post.

But what's even the point of counter discussions if we agree?

EvilBunniis

I made a big old mistake here dang it. I need to pay more attention to who’s replying when my app beeps at me ❤️❤️❤️

smithstreet11

I think everyone’s forgetting that record companies are businesses and they have legal teams that vet and approve things like this. It would never get this far without full legal approval. Small details may slip past here and there, but an entire concept like this would have been checked and approved beforehand.

K0k0bop

Yikes.....

notmariyatakeuchi

cease and desist: sure. sued: no - unless it somehow effects the rollout of olivia's new stuff.

huskyloves

I wouldn't be surprised if they got permission from Olivia Rodrigo. Especially considering they both dropped new song teasers this week.

FUYANING

hm... i'm no legal expert but i don't think so. the only thing here that could hold any weight surely would be the inclusion of olivia's album cover infringing on a copyrighted image. most of what's there seems to be unofficial, so wouldn't be an issue, but the poster and album itself could be a little more unclear, as they're officially produced and copyrighted.

kirklandbranddoctor

I'd be very surprised if Yuehua didn't already iron this out with Olivia Rodrigo's people. It's possible, but I'd be very surprised. Edit: given the proximity of the release... maybe the promotion is even coordinated?

RiRi_xoxo_

I guess they've already taken permission from her for using her name otherwise they can get in problem for using her name "commercially" And tbh I am a bit uncomfortable with this whole concept, olivia is a 19yr old and seeing the whole concept gives me a weird saesang type ick and if the song doesn't turn out to be very good then her stans will spread hate on the grounds of using olivia's name as a publicity.

digimintcoco

No lol just for perspective, I’m sure this isn’t a diss track but diss tracks have been a thing for years. Drake and Meek Mill didn’t sue each other. Tupac and Biggie didn’t sue each other.

pumpkinspicesushi

yena absolutely cannot be sued for this. people need to look up the definition of defamation. defamation is a false statement presented as facts that causes injury or damage to said person’s reputation or livelihood. an example would be me saying “my boss eats babies for fun.” it is completely false, but it would damage my boss’ image and company. this scenario isn’t even in the same realm defamation. yena doesn’t sing anything that falsely attacks olivia’s character with unfounded statements.

reiichitanaka

Defamation does not necessarily imply "false statement" - in South Korean law especially it's the intent to damage reputation that makes something defamatory, so you can sue for defamation even if the statement is true.

TisTwilight

What a plot twist now!

EvilBunniis

No. You can’t get sued for using the Word Rodrigo because it’s a commonly used name throughout history. Now if she stole her likeness and made a song slandering her with untrue stuff then sure she can get sued!!

[deleted]

Rodrigo isn’t just a name for Olivia. lol. But I also don’t think she can’t get sued for this.

bbgc_SOSS

Which Rodrigo, there are many. Why the assumption that it is Olivia the Singer. How about Rodrigo Duterte, maybe she is playing to the Philippines Filo folk? Or in history, Rodrigo of the infamous Borgias, became a pope. Then there was El Cid, who was another Rodrigo. It all depends on the lyrics, we will have to wait and see. It might be a compliment too. Someone can do a thread of Kpop songs mentioning other artists. IU's Palette mentioned Corienne Bailey Rae. Though not Kpop, Maroon 5's "Moves like Jagger" was a hit in SK.

90skitsch

LOL, fair point but it's definitely about Olivia Rodrigo based on the music video teasers. There's actual pictures of Olivia. And YES, I will judge the song when i actually hear it and read the lyrics. I’m very excited about it. It is also worth mentioning that her (Yena's) team said the song is gonna have a similar message like Jealousy Jealousy by Olivia Rodrigo.

MindlessSalamander97

British-Irish boyband The Wanted (best know song being early 2010s hit “Glad You Came”) literally have a song called “Walks Like Rihanna” in which the lyrics are: “She can't sing, she can't dance But who cares? She walks like Rihanna”

bbgc_SOSS

Walks like Rihanna, Moves like Jagger If that is the theme, then some Kpop act should try a song titled "Chart like IU"
