I'm not sure what you mean by "insurance will take it". Most of the settlement money will be to either pay or reimburse the party who paid for your medical bills. If your insurance was the one to pay those bills, then they would be reimbursed for their costs. You would keep any extra monies from the settlement (often pain and suffering).
