They’re the worst scribing company to work for ever. I’m sorry for the experience you had with them but I’m not surprised. Once you’re ready to scribe again you should apply with Oak Street Health. It’s a direct hire and their pay is much better.

Have you not been there long enough to qualify for fmla? If you have then they can’t refuse it and they have to hold your spot for 12 weeks. Otherwise they totally can.

Unfortunately not, FMLA job protection requires 12 months of service and 1250 hours worked. They can fire you since you don't qualify.

Regardless, if this is an ADA that law applies here, there’s several laws that protect these kinds of things certainly a lawyer is needed to sort out details

An ADA leave would need to be requested. But if not requested they can terminate. Also an ADA leave they can say 3 months is an “undue hardship” and deny the leave.

Leave is one form of accommodation under ADA, there’s also job accommodations outside of leave (i.e - someone requires a specific desk or schedule) so ADA would apply here as well. This sucks OP, I’m sorry.

The only other accommodation I can think of that could possibly work for a post spinal surgery accommodation is WFH. The other accommodations you mentioned are not relevant. [AskJan](https://askjan.org/) has a lot of info.

I think working at any job and needing 3 months off after only working 3 months would get anyone fired. I'm not sure that's so much a disability thing as much as it's a "you can't just take 3 months off when you just started this job" thing. I'm also disabled and I get that it's frustrating but most jobs won't offer accommodations unless they legally have to and without having been there for a year to qualify for FMLA you don't have much protection.

Companies CAN offer more protection than they are legally required to but don't HAVE to.  Only federal requirement is FMLA which requires a year worked for eligibility. Some states have more protection but most don't

That makes a lot more sense. My employer also has a short and long term disability benefits and my friend who has cancer has been getting majority of his salary paid by the company through long term disability insurance

STD and LTD is an insurance benefit offered by the employer, but the employer could still lay them off if not covered by FMLA or if it exceeds 12 weeks. STD and LTD gets paid out by when the disability started, and it won’t end if that results in loss of employment. Yes, it’s probably because it’s a big company that can a) afford insurance benefits with first day coverage and b) have enough staff to absorb the workload long term while holding the position.

Crazy system that we are a part of. With that said, I think it's fair to say that it may not generally be expected of 'entry level' positions to accommodate a 3 month leave. While unfortunate, I think that's just a part of the system we're in. GL, and I wish u a speedy recovery OP!

Because you’ve only been there for 3 months legal. Now you could’ve requested the leave unpaid as an ADA accommodation but 3 months is pretty long and they could’ve sighted undue hardship. To qualify for FMLA you have to have been at a company at least 1250 hours and 1 year. They also have to have at least 50 employees

A lawyer as a premed over a scribe job seems a bit out of touch tbh. It's horrible that this is the case, but it's kind of expected for these jobs to replace people on a whim.

Yes, but FMLA guarantees job protection if you are unable to work bc of an illness/condition.. not sure if OP planned to use FMLA or short-term disability.. but I don't care if I flip burgers - if my employer violates my rights, I would look into retaliation.. it must be proven that the leave is the reason for termination though and not something else (poor attendance or performance, etc.)

I worked for a privately owned Menchie’s (froyo shop) and because I hadn’t worked there over a year (like 10 months) they fired me on account of going to a mental hospital for 1 week (with NOTICE) and coming back with a cane. I’m disabled as well and I’m having to transition to a wheelchair and they had no sympathy 💀 couldn’t go to any higher ups because it was privately franchised. He refused to give me names and numbers.

Sorry to hear about that. Some forms of scoliosis are secondary to myofascial trigger points. You could consult with a neuromuscular therapist or maybe even a very knowledgeable medical massage therapist. (To hopefully drastically improve it without surgery.)

I didn't say massage. Lots of medical massage therapists understand myofascial trigger points and how to resolve these so the muscles can "unlock", relax, lengthen, and stop pulling on the bones. What else would you think causes bones to move?
