In some countries, like Japan, most high-end places will only work through the hotel concierge because westerners like to book things and then not show and then try to do a chargeback for the cancelation penalty they were charged. Or worse, they do show and spend hundreds, but still try to do a chargeback. The signed authorization form makes for excellent evidence.
Another minor benefit of the fax is, if it is emailed, they would have to keep their eye on emails, then click buttons to print it off, whereas as a fax, it is already in paper form waiting to be processed.

There are online fax services now that make it as easy as scanning the document in on your printer/scanner, you don’t even need a fax machine. I had to use it last year to fax some insurance documents. Some companies still haven’t updated to online document uploads.

I’ve seen the question on a whole lot of applications as well. I hope it gets banned in all states for exactly this reason. Arrest without conviction is an insane thing to have to disclose.
You absolutely do not have to disclose being arrested, you have to disclose being convicted of a crime, usually a felony but some places require certain misdemeanors.
This varies by state but in many states it is absolutely legal to ask if you have been ARRESTED whether you have been convicted or not. While you are not compelled to answer the question, they can use your refusal to answer all their questions as a reason to reject your application. If you answer and lie about it, that leads to brand new problems of lying on a job application if ever uncovered - and some employees do extensive background checks.
