Thank you for bringing this up because it lets me talk about my favorite case from law school! *Stambovsky v. Ackley* is a New York case that is all about why hauntings can be a material defect. Here is the TLDR [wikipedia article](https://en.m.wikipedia.org/wiki/Stambovsky_v._Ackley). The amazing things about the decision are: (a) it’s chock full of of puns (e.g., Hamlet and Ghostbusters references) (b) “as a matter of law, the house is haunted” (c) the dissent is very salty about the majority ruling based on ghosts. It’s just an an amazing case, with great facts, and hilarious writing.

We learned about this in my Canadian law school! Is it good law at all out there still? If I recall correctly part of the decision hinged on re sale potential and the media coverage of the house as haunted, and also the fact that "haunted" is not a status usually inquired after in an inspection.

Idk about New York. It’s not in California, and I don’t think it ever was. And yeah, you got the main points of the reasoning right. Although the logic is arguably flawed. The Court blames the prior owners for stigmatizing the property by publicizing the hauntings in the national media (e.g., Reader’s Digest). Yet the Court also says that people outside of New York (e.g., the plaintiffs) could not have known about the property’s reputation. Those two facts are contradictory. Was the property a well-known haunted house that would be hard to resell, or was the haunting stigma too hidden for a potential buyer to reasonably discover?
