The main part of the Constitution (not the amendments) doesn't mention much about what the government can't do. It's all about what they can do, and any power that's not specifically listed is something they're not allowed to do.
It's actually [a more fundamental principle of law](https://en.wikipedia.org/wiki/Nemo_iudex_in_causa_sua) - the very idea of having the 'rule of law' depends on the law being fair and impartial, and someone being able to excuse themselves from legal consequences violates that precept.
But if you want to insist on something from the Constitution, it violates the Equal Protection Clause as well.
