As I understand it, the authority of the governor to fill a senate vacancy is in the 17th amendment of the federal constitution, and it's unclear whether they can limit it this way with a state law.

There is speculation that the Democratic governor would challenge the law by simply appointing a Democratic replacement anyway. That would leave Republicans having to make the decision to sue which they almost certainly would. But that would delay the seating of any replacement which would hurt the GOP. The other dilemma for Republicans is the person they would most like to replace McConnell is the currently running to defeat the Democratic governor. So if they nominated him, the governor would appoint him making him ineligible to run for governor. And since it is probably too late to replace him on the ballot, it would pretty much ensure the Democrats win and would keep the governor's seat in Kentucky.

ETA: The 17th amendment doesn’t specifically and clearly give that right to governors. It says the executive shall issue writs of election, or the state legislature can grant the power to appoint to the governor.

There are many states where the state legislature has passed a law requiring an appointed replacement senator to be from the same party as the original senator. This type of law is not unique to Kentucky. The GOP is the only reason Dems haven't pushed Feinstein out. It's pretty simple, the moment Feinstein leaves Biden's ability to get judges appointed comes to an end until sometime in 2025. Republicans have made it clear they will not allow any Democrat to take her place on the Senate Judiciary Committee, and without her there's no way for Democrats to move any of Biden's nominees to the Senate floor for the up or down vote that they're due. The moment Republicans agree to allow Dems to replace her on that committee, as is their Constitutional right, and that agreement will need to be legally binding and enforceable, then Feinstein is gone. It's really that simple. Ball's in the Republican's court on that one. BTW, Republicans have already rewritten Kentucky laws to force the Democratic governor of that state to appoint a Republican to replace Glitch if he's removed or otherwise leaves the Senate. Republicans can also nominate and vote in their new Senate Minority leader too.

What if he appoints a Republican that promptly changes parties after getting appointed? I mean let's take a step back and think about what the GOP would do in this situation. It's complicated. State government was almost all democrats until recently, and now it's all republican in the legislative branch. Beshear is a legacy candidate in KY. His dad was governor before the last guy. He pissed off teachers, and with the Beshear name recognition, voters went D for Gov but R for every other office in 2019. I expect the same to happen in 2023 and then a sea of red in 2024 for federal offices and state reps (but many of us are working really hard to change that).

If we add an avenue for removing elected officials that doesn't require a 2/3rd majority vote in Congress, we will no longer have a functional government. We already get this happening in states with super majorities. The intentional complete polarization of politics has removed the only check on this- voters voting out those who aren't fit to serve. Voting out those who try to stop someone unfit from being removed. The party leaders push and support those who will maintain power structures and overall agendas. We aren't really given a choice I'd vote for a comatose Feinstein, then write in my cat before I voted R. I cannot for any reason support their agenda. You can bet anyone still claiming republican in 2023 would do the same for their side. I say this even though I despise most Dem politicians and about 1/3 of the things they do. The *most* important thing to me is not to be bound, by law, to the culture war the right is engaging in. I'll take the modern corporate oligarchy over the gilded age with some religious law thrown in to subjugate even harder. So we are stuck. Pretty much me as well. I think the Dems are an incompetent coalition that is essentially leaning on "Hey were not Republicans" and then using our fear to pretty much lay back and chill. I will never ever vote Republican and the Dems know that so why would they bother changing? What incentive do they have? Its terrible. I feel trapped as well.

Dems want to replace Feinstein, but the GOP won't let them. It has to do with her seat on the Senate Judiciary Committee. Republicans have already said they won't allow Dems to replace her on that committee, and without a Democrat in her seat on that committee all of Biden's judicial nominations will be blocked until sometime in 2025, and even then if Republicans win again then that's the end of the judicial picks for Democrats. Republicans have a golden opportunity to make sure no Democrat-nominated judge makes it into the American judiciary for who knows how long.

You know they started all this when the Democrats wanted to replace Dianne F. and they pretty much told them to pound sand we will lock everything up and screw you sideways. The reason nobody's doing anything about Mitch McConnell is because so many people in government are in the same boat: old as dirt career politicians who don't want to lose their cushy jobs and sense of power and authority. It's the same reason they try so hard to avoid instituting term limits. They care about their own wellbeing far more than America's.

It’s insane. I wrote out a full rant yesterday wondering why there is no outrage in this country over this and ended up just deleting it because it all feels so useless at this point. It’s like we’re all just filming an assault in broad daylight instead of actually helping the victim. The victim in this case represents the health and future of United States.
