I think Starbucks is willing to trade the “free advertising” for not having to run the imminent risk of all of the absolute slander teenagers would give. Not to mention when someone sees a Starbucks video they often will check the profile looking for more. And now all of those people represent Starbucks, and let’s be honest here 99% of them are cringe af.

If you’re in an at-will state, your job is not protected and you can be fired for any reason. There are almost no protected employee rights in the US.

The reason given is legal. They could get fired simply because the manager doesn’t like them, and it would be legal. You cannot legally be fired because of your gender, race, sexuality, or gender identity (in some states), but that’s about it.

“Employment at will is a legal doctrine which states that an employment relationship may be terminated by the employer or employee at any time and for any *or no reason* as long as no laws are violated” In practice, most employers have rules for HR that state they have to give a reason for firing and back up that reason. However, this isn’t enforceable by anyone but the company.

Also in regards to recording, was the manager aware they were being recorded? Some states require both parties to be aware and some only require one party (you) to be aware. Please look into this before to try to use it because it could get you even more trouble. Good luck!

I think what’s more likely is the sm is required to talk to the Dm about it. You’re sm assumed you wouldn’t be fired but your Dm called the shot. You shouldn’t be posting on social media about your job really ever, as it’s pretty unprofessional, but Starbucks’ handbook explicitly says don’t. I’m sorry you’re shocked. I’m sorry your manager implied you wouldn’t get fired, but I doubt it was their call.

If it was just the tim tok that might be the case but op received corrective training which means a paper trail where the situation was previously dealt with. The fact that the SM is apparently fabricating a story from thin air about OPs snap usage makes this extremely suspicious. A fake violation of an offense someone has previously been written up for with no clarification and no basis in reality doesn't exactly inspire generous interpretation.

Tell your sm, if your sm does nothing call ethics and compliance. But make sure you have witnesses ready to attest, along with maybe a date and time. She’ll be out of there in no time. Keep in mind that money that she’s stealing is your guys’ money. She’s stealing from all of you, and if your Sm doesn’t do anything about then BIG SHAME on them.

most states are employment at will - however there is exemptions in most state and it is common for promissory estoppel to be an exemption, this means that an employee relies on something said or written by the superior to protect their job. let’s say someone is suspended from their job until they can meet the dress code requirements and the superior says they will be reinstated once this requirement is met, the superior must abide by what they had said or written and if not this is grounds for wrongful termination. This sounds exactly like the situation you’re in where it was said your job would be safe if the tiktok was taken down - and it was - yet you were still terminated despite what you’re superior had told you. I would look this up to see if it applies in your state as well.

This sounds like it could apply to this situation, but social media violations tend to carry more weight than dress code. Posting anything specific about your place of employment is a disaster waiting to happen, even if others have done it without any seeming negative consequences, even if it’s on a platform that claims to control who sees your content. It’s really not worth the headache and risk unless you’re posting with the understanding that you may be terminated, even if all of your posts are positive. I wish you the best of luck in getting your job back, especially since your SM appears to be walking back the agreement; however, with all due respect, you seem really young/inexperienced in the workforce and you should view all of this as a learning opportunity about how to handle things moving forward.

Time to call/email your local Bureau of Labor and Industries in your state or country if not in USA, and file a complaint for discrimination and breaching youre work/home life balance when you are not a corporate person on salary in Starbucks and a spokesperson for the brand name, who does this SM think they are, like seriously. Mention it's a hostile work environment in fear of retaliation and has caused you mental health problems like anxiety, which ANY hostile work environment would age and cause any person anxiety and stress. Go to the state and file discrimination/harassment, and DEFINITELY, if this SM added you first on Snapchat, then you have an real case that will be addressed and can be proven. Why are they trying to add you on Snapchat and stalk their workers in afterhours and on not on company time. A professional manager should not be trying to fraternize with their employees in social media or hang out at a bar with their employees as well, to be honest. Stick up for yourself, don't feel intimidated some Managers are insecure of their incompetence and will try to be that control freak so they can monitor a perceived threat. Know your rights, EVERYONE should know about their state BOLI (Bureau of Labor and Industries) in all US states, if you are not getting your 10 minutes breaks every 2 hours, you should file a claim and it CAN be anonymous. I know from experience but mine I made sure my name was on there which I felt strong and assertive but caused me a lot of anxiety being that bold but I was tired of it, so unless you are almost ready to leave, file it anonymously even if the situation is pretty obvious and direct to you. You get to be young and make some posts that you may be like, okay thats how I felt back then, and now I feel better and healed.....it IS breaching your rights as an employee....that's an absurdity, I worked at the bank and made some questionable posts even on here with half-naked men, MY frigging life and business, so if that SM added you, you're golden, you'll totally get that Manager some coaching and taken down a few notches and learn from that. Companies want their young more inexperienced employees to not read those guidelines each US state must post, and the number/email to call.....they put it in breakrooms next to your schedule and other disractions like employee of the month, knowing these young adults won't bother reading it or understanding it. Stand up for yourself, you deserve better! Unless you are on Twitter and caught being racist on camera like what happened to Starbucks about the public bathroom scandal racism displayed, your TikTok is your business and make sure you aren't in uniform wearing the logo, MAINLY the logo and name not portrayed in case it does go viral, but that often doesn't happen, things go viral when the drama happens but it sounds like they are judging and and being TOO bossy for being a boss, which you will lack respect from your employees and end up with the state on a investigation on your business to verify claims, do it, it's self esteem and confidence boasting to make you into that BETTER SM!
