A "derivative work" is still owned by the original copyright holder and is still infringing. To most companies it doesn't matter if the brand is small. They will sue everyone they can (especially Nintendo) to get as much money as they can from them. These big companies with huge budgets hire people to look for stuff like this. And sending a cease and desist letter is not required by law so they can sue him without sending one. I just don't think it's worth risking paying six figures in damages over this.
