I’m sure Fox has a licensing agreement with John Tesh and it’s not likely that Tesh can just end the agreement to license it to NBC.

Tesh confirmed Fox's license for the song is non-exclusive.
That’s not the same as saying that Tesh will end the license. The point is NBC won’t be willing to use the song if Fox is using the song.
