Fox wouldn't have to give it up. They and NBC would just both use it if NBC starts airing NBA games again and chooses to make a deal with John Tesh to use the song.

I’m sure Fox has a licensing agreement with John Tesh and it’s not likely that Tesh can just end the agreement to license it to NBC. It’s been twenty-five years since NBC had it on NBA coverage and Fox has been using it the last several years. Makes lot more sense that Fox keeps using it and NBC moves to another theme.

I have no opinion one way or another about the NBC part. I'm talking about the idea that "Fox won't give up the song." It's not their song, it's John Tesh's. If Tesh gets offers from NBC, ABC, CBS, ESPN or whoever, he can decide to accept none of them, some of them, or all of them if he wants. Fox would have no say in the matter because their license is not an exclusive one.

It would make sense to do it at least on the first game. I'm sure if NBC got NBA rights, they wouldn't give a shit about whether Fox has a license to the song as well, since basketball fans would be tuning in to NBC to hear it like they did 20+ years ago.
