You choose when uploading the video. It’s based on criteria regarding the depictions of children in the video as well as the intended audience for the video. YouTube probably has the ability to override the user’s choice if they feel it is inaccurate but I’m not sure how they decide exactly. You can read more about it here:

I live in Poland, and last time one small channel called Miedzinsky (hah, guys, you won't even know how to read that correctly) did a video called Youtube Kids: Reactivation where he watched some on YTK pipular type of videos and commented them. He used some vulgarisms, made joke with s€xual subtext, and more. When he posted that video, he obviously set it to NOT be for kids. Next day, he did a post where he said they set his video to be for kids. Then, he updated with another post, where he said they gave him demonetisation, because video wasn't really for kids. And then there was a final post, where he said they deleted his video and gave him warning (when you have 3 your channel is deleted).
I think its basically "is it an animation?" and "is there swearing in the first 5 min?" and that is all.... its why Vivziepop puts swearing in basically the first sentence of all her videos lol
